He is the author of The Tanhuma-Yelammedenu Literature: Studies in the Evolution of the Versions (Gorgias Press, 2003). In 2006, Bregman was appointed the Herman and Zelda Bernard Distinguished Professor of Jewish Studies at the University of North Carolina in Greensboro, where he also headed the program in Jewish Studies, until 2013. Bregman retired from UNCG as of July 31, 2017. (He was the first-born; but when he defiled his father\u2019s bed, his birthright was given to the sons of Joseph son of Israel, so he is not reckoned as first-born in the genealogy. Though Judah became more powerful than his brothers and a leader came from him, yet the birthright belonged to Joseph.) The sons of Reuben, the first-born of Israel\u2026\u201d. The words above enclosed in parentheses seem disconcertingly inserted between two beginnings of the listing of \u201cthe sons of Reuben, the first-born of Israel.<\/span><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This phenomenon, found here and elsewhere in the Hebrew Bible, is referred to as<\/span><a href=\"https:\/\/www.thetorah.com\/article\/the-resumptive-repetition-wiederaufnahme\"> <span style=\"font-weight: 400;\">resumptive repetition<\/span><\/a><span style=\"font-weight: 400;\">. The Chronicler here explains how it was that Reuben was the \u201cfirst-born\u201d of Jacob (see<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.32.28-29?lang=bi&amp;with=all&amp;lang2=en\"> <span style=\"font-weight: 400;\">Gen 32:28-29<\/span><\/a><span style=\"font-weight: 400;\">), but then, how the \u201cbirth-right\u201d was bestowed on \u201cthe sons of Joseph\u201d (apparently a kind of \u201cinner-biblical midrash\u201d on<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.48.3-5?lang=bi&amp;with=all&amp;lang2=en\"> <span style=\"font-weight: 400;\">Gen 48:3-5<\/span><\/a><span style=\"font-weight: 400;\">), though Judah ultimately became the chief of the Israelite tribes (see<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.49.10?lang=bi&amp;with=all&amp;lang2=en\"> <span style=\"font-weight: 400;\">Gen 49:10<\/span><\/a><span style=\"font-weight: 400;\">). The downfall of Reuben, who \u201cdefiled his father\u2019s bed\u201d, is a brief reference to Reuben\u2019s having \u201clain with Bilhah, his father\u2019s concubine\u201d (see<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.35.22?lang=bi&amp;with=all&amp;lang2=en\"> <span style=\"font-weight: 400;\">Gen 35:22<\/span><\/a><span style=\"font-weight: 400;\"> and<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.49.3-4?lang=bi&amp;with=all&amp;lang2=en\"> <span style=\"font-weight: 400;\">49:3-4<\/span><\/a><span style=\"font-weight: 400;\">). This chain of events violates the rule of primogeniture stated in<\/span><a href=\"https:\/\/www.sefaria.org.il\/Deuteronomy.21.17?lang=he&amp;aliyot=0\"> <span style=\"font-weight: 400;\">Deuteronomy 21:17<\/span><\/a><span style=\"font-weight: 400;\">, according to which a \u201cdouble portion\u201d of paternal inheritance is due the \u201cfirst-born\u201d son, according to the \u201claw of birth-right.<\/span><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><\/p>\r\n<p><span style=\"font-weight: 400;\">According to<\/span><a href=\"https:\/\/www.sefaria.org.il\/I_Chronicles.5.2?lang=bi&amp;p2=Bereishit_Rabbah.82.11&amp;lang2=bi\"> <span style=\"font-weight: 400;\">Midrash Genesis Rabbah<\/span><\/a><span style=\"font-weight: 400;\">, Rabbi Shimon interpreted the curious formulation of the first verse of I Chronicles 5 as indicating how difficult it is for God to \u201cuproot a genealogical chain from its place.\u201d For it was only because of Reuben\u2019s misbehavior that his birth-right was given to the sons of Joseph, while Reuben retained the genealogical status of \u201cfirst-born.\u201d Rabbi Levi countered that Reuben, because of his sin, was subsequently no longer even reckoned as the first-born, since I Chronicles 5:1 clearly states that Reuben was \u201cnot reckoned as first-born in the genealogy.\u201d\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">However, Rabbi Haggai, in the name of Rabbi Yitzhaq comes to the defense of Reuben and his descendants by noting that even in the very moment of his transgression, the birth-right is assigned to none but Reuben. For when Scripture relates that \u201cReuben went and lay with Bilhah, his father\u2019s concubine\u201d, it goes on to speak of Reuben as \u201cJacob\u2019s first-born\u201d (see<\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.35.22-23?lang=bi&amp;aliyot=0\"> <span style=\"font-weight: 400;\">Gen 35.22-23<\/span><\/a><span style=\"font-weight: 400;\">). Rabbi Yudan said in the name of Rabbi Aha that Reuben was the first of his father\u2019s children to be conceived, the first to be born, he first had the birth-right and his father\u2019s inheritance, and he was the first of his brothers to repent their sin against Joseph (see\u00a0 <\/span><a href=\"https:\/\/www.sefaria.org.il\/Genesis.37.29?lang=bi&amp;aliyot=0\"><span style=\"font-weight: 400;\">Gen 37:29<\/span><\/a><span style=\"font-weight: 400;\">). Once that formality was observed, the genealogical listings reverted to seniority by age; hence, Reuben, the firstborn, followed Judah with the accompanying explanation that \u201che is not reckoned as first-born in the genealogy; though Judah became more powerful than his brothers and a leader came from him\u201d (1-2). While the assertion that \u201chis [Reuben\u2019s] birthright was given to the sons of Joseph\u201d (1) might presume that Joseph\u2019s genealogies should follow, Malbim explained that Jacob awarded Joseph primogeniture and, hence, he was replaced by two of his sons, Ephraim and Manasseh; however: \u201cHe was not accorded precedence in matters of genealogy.\"<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">We recall that Moses had acceded to the request of those two and one-half tribes to reside in Trans-Jordan on condition that they assist in the conquest of on the \u201cother\u201d side of the Jordan River (Numbers 32). After the conquest was (largely) concluded, Joshua affirmed that they had fulfilled their commitment and they returned \u201chome.\u201d Here we discover that throughout the earlier biblical era, these tribes were forced to fight a series of defensive battles mostly against opponents called \u201cHagarites\u201d (ostensibly descendants of Abraham through his concubine Hagar, mother of Ishmael), first during the reign of King Saul (10) and later during the reigns of Jotham, King of Judah, and Jeroboam II, King of Israel (19-20).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Eventually, however, these two and one-half tribes were among the first victims of the Assyrian conquest of Tiglat Pileser and were exiled to Asia Minor, as reported here (25-26) and in 2 Kings 15:27-29, which stipulates that \u201cHe [King Pekah of Israel] did what was displeasing to the LORD; he did not depart from the sins which Jeroboam son of Nebat had caused Israel to commit\u201d (28).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">A striking instance of intertextuality is achieved if we interpolate vs. 25-26 of our chapter into the narrative of 2 Kings and discover that not the king alone, but the larger population as well \u201ctrespassed against the God of their fathers by going astray after the gods of the peoples of the land, whom God had destroyed before them. In chapter five, more story starts to creep in. The first half of chapter 5 deals with the two and half tribes that lived on the eastern part of the Jordan river. In Numbers 32, we learn that the tribes of Reuben and the tribe of Gad wanted to stay in the lands on the eastern bank of the Jordan river. Much like Lot centuries earlier, these tribes desired the lush fields for their flock. Moses acquiesced to this request and included half the tribe of Manasseh with Gad and Reuben. In Joshua chapter 1, Joshua reminds the two and half tribes that Moses\u2019 promise came with a condition- that they fight with their brethren to conquer the land. The two and half tribes fulfil this promise, and then return.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In Chronicles we see what happens to them. The outer tribes battle the descendants of Hagar (Ishmaelites). Ultimately, they fall into sin, \u201cthey strayed after the gods of the people of the land that God had destroyed before them\u201d (5:25). God then sends the Assyrians to exile them forever.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">There are a few conclusions from the first part of the chapter. Verses 1-2: Continuing with the theme that the book was written from the perspective of the tribe of Judah, the author makes sure to remind us that although Reuben was born first, he was not the ultimately heir to the throne. In fact, the author elevates the tribe of Joseph as well by pointing out that Joseph was given the birthright, while Judah was given the kingship.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Praising Joseph conflicts with what we have seen so far, so why mention it? Because Reuben was the first born it was imperative that the author make sure his claim to the throne is disproven. Therefore, the author is willing to elevate the tribe of Joseph if it means knocking down the tribe of Reuben.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The second point is the ending warning that the tribes worshipped the gods of the eastern Jordan. It would have been fine to simply tell the story from a historical perspective providing details of the tribes\u2019 triumphs and also their destruction. Including the reason behind the downfall is meant to link this reason with the ultimate downfall of the kingdom of Judah. Cynically, one could say the author is linking the downfalls to excuse the destruction of Jerusalem for the same reasons. However, it is more likely the author is warning the reader that it was not a unique punishment that God eventually metes out to Jerusalem. The very first tribes to be exiled- those of Reuben, Gad, and half of Manasseh were also guilty of turning away from God and following the gods of the local community.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It is also a warning to the people who return after the exile during the time of Ezra. The portion of Menashe, is much further south in Josh. 13. The exile of the Trans-Jordan tribes is mentioned in two places in the book of Kings: the conquest of Tiglat-Pileser in 2 Kings 15:29, and the exile of Sargon, 2 Kings 17:1-6; and more.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\">Birthright (<em>bechora<\/em><span>) and choice (<\/span><em>bechirah<\/em><span>). It\u2019s official: Joseph is the firstborn, instead of Reuben, and Judah is the king. There are reasons for this. Reuben: \u201cHe was the first-born; but when he defiled his father\u2019s bed, his birthright was given to the sons of Joseph,\u201d a reason which was hinted at also in Jacob\u2019s words to Reuben in Gen. 49. \u201cJudah became more powerful than his brothers and a leader came from him\u201d (verse 2).
