A cautionary tale for us, today\r\n\r\n","post_main_content_content":"<p><span style=\"font-weight: 400;\">One of the most basic principles of justice, equality before the law, is learned from the beginning of this chapter.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Talmud (Sanhedrin 18a) asks, how do we know that the High Priest, sitting at the pinnacle of the religious hierarchy, can be judged in a court of law? The answer given is the verse from Zephania 2:1, \u201cGather together, gather, O nation without shame.\u201d The connection seems thoroughly obscure. Resh Lakish illuminates it, explaining that the repetition of the word \u201cgather,\u201d to mean \u201cstraighten yourself out first before you straighten out others.\u201d (Rashi comments on this verse that the Hebrew word \u201ckoshesh,\u201d gather up, also has the connotation of straightening and making something even.)<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This inference builds on the Mishnah\u2019s statement that a High Priest may judge. For Resh Lakish it is inconceivable that someone should be able to judge, without also being subject to judgment. \u201cStraighten yourself out first!\u201d If you are unwilling to accept correction from the legal system, you are not qualified to mete out justice to others as part of that system.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This principle of equality is obviously of huge significance to Jewish and Western Law. Those in charge of the administering justice must also be subject to its dictates.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">However, there is one major exception that the Talmud and Jewish Law makes to this principle. On the next page, the Talmud affirms that kings from the House of David, who respect the legal system, may serve as judges, and are also subject to judgment, and derives this from the same verse in Zephaniah 2:1. Kings of the House of Israel, on the other hand, do not judge, and are not subject to judgment by a court.\u00a0 Why not?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Maimonides (Laws of Kings, 3:7) explains, \u201cthey hold the judges in contempt and so harm and damage will come from it.\u201d The Talmud explains this reticence by citing a story of how Yannai, a non-Davidic King, was summoned before a <\/span><i><span style=\"font-weight: 400;\">bet din<\/span><\/i><span style=\"font-weight: 400;\">, a court,<\/span> <span style=\"font-weight: 400;\">by Shimon Ben Shetach when one of Yannai\u2019s servants was accused of murder.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Yannai intimidated the other judges, who would not stand up to him, and as a result, they died as a punishment from heaven. \u201cAt that moment, they said, a non-Davidic king should neither judge nor be judged.\u201d (Sanhedrin 19b.)<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The lesson is a challenging one. Absolute equality of all before the law is a compelling moral principle, that Shimon Ben Shetach was zealous to apply. There is a common pattern to this message: these nations were all haughty, they mocked and abused Israel, and will now be cast out of their lands, which will be in some way returned to nature. This return to nature takes a number of forms: some lands will become \u201cdeserted\u201d and \u201cdesolate\u201d (v.4), some will be laid waste (v.5), some will \u201cbecome an abode for shepherds and flocks\u201d (v.6), and some will be reclaimed by wild animals (v.14).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">There are, in all this, only a few references to Israel inheriting the land of their defeated enemies. One might expect this to in fact be the main topic of this prophecy. After all, isn\u2019t the opposite of us being defeated by our enemies the conquest of our enemies? By breaking this paradigm, the prophet is providing us an important reminder, and making a fascinating point.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The reminder is one that appears frequently in Tanakh: that God is the Master of the Universe. The focus of the chapter, from God\u2019s acts of destruction to the results of that destruction, puts the power solely in God\u2019s hands. The prophet emphasizes that all these powerful nations will be simply swept aside by God\u2019s anger.\u00a0\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The fascinating point the prophet is making is that the absence of one people is not the presence of other people, it is nature. Throughout Tanakh, one people is replaced by another. Whether it is Israel\u2019s conquest of the Canaanite nations in the time of Joshua, Israel\u2019s oppressors in the book of Judges, the nations David defeats in his various conquests, or the empires that eventually conquer Israel and Judah, one nation always drives out another. This seems to be an unbreakable pattern of human life and history.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But this prophecy changes that. Humans are replaced by nature, by fields and pastures, jackdaws, owls, and ravens (v.14). The message is a profound one: where we humans see a void left by other humans, God sees the natural world, the Creator\u2019s vision of a world shared by humanity <\/span><em><span style=\"font-weight: 400;\">and<\/span><\/em><span style=\"font-weight: 400;\"> nature. The prophet is telling us that nature, a return to it, the natural world, are necessary parts of human history and life. Seek the LORD, All you humble of the land Who have fulfilled His law; Seek righteousness, Seek humility. Perhaps you will find shelter On the day of the LORD\u2019s anger\u201d (verses 1-3).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Zephaniah hopes that the fear that he has aroused among his listeners in chapter 1, describing the horror of the quickly approaching \"day of the Lord\", will become the springboard for meaningful change. He uses imagery taken from the procedure for separating straw from chaff, i.e., taking good from bad. The command to gather is repeated with a variation on the same word (<\/span><em><span style=\"font-weight: 400;\">hitkosheshu va\u2019koshu<\/span><\/em><span style=\"font-weight: 400;\">), which is related to the word for straw (<\/span><em><span style=\"font-weight: 400;\">kash<\/span><\/em><span style=\"font-weight: 400;\">). In verse 2, he warns the people against being like the chaff, the worthless part of the harvest that is easily and quickly blown away.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Zephaniah\u2019s metaphor for the upcoming judgment is the act of winnowing: Just as the one throws the straw left from the threshing into the wind to divide the straw from the chaff, so too, when the wind of judgment will blow through the nation, the people will be separated into the righteous (straw) and the wicked (chaff).\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The command to gather (<\/span><em><span style=\"font-weight: 400;\">hitkosheshu va\u2019koshu<\/span><\/em><span style=\"font-weight: 400;\">) is repeated, first in the reflexive form and then in the imperative. With regard to this repetition, Radak quotes the following rabbinic homily:<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">\u201cSeek out your blemishes and then seek out the blemishes of others, and eradicate them. And so the sages said from this verse, \u201cDecorate [<\/span><em><span style=\"font-weight: 400;\">make honest<\/span><\/em><span style=\"font-weight: 400;\">] yourself, and then decorate [<\/span><em><span style=\"font-weight: 400;\">make honest<\/span><\/em><span style=\"font-weight: 400;\">] others\u201d (Bava Batra 60b).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">At the same time, Zephaniah makes no guarantees that his listeners will survive, even if they repent and act with humility and righteousness. Amos stated that if the people \u201cHate evil and love good, and establish justice in the gate; <\/span><em>perhaps<\/em> <span style=\"font-weight: 400;\">the Lord God of Hosts will be gracious to the remnant of Joseph\u201d (5:15). Zephaniah is similarly noncommittal. Since the decree of \u201cthe day of the Lord\u201d had already begun, there is no chance of it being completely recalled or annulled. The best that Zephaniah can offer his listeners is that if they repent, they will be able to find some form of shelter during the upcoming storm. The Talmud relates how this verse (Zephaniah 2:3) caused R. Ami to break down into tears: \u201cR. While armies who mete out Divine judgments, will in turn feel the brunt of God\u2019s anger for \u201cgoing too far\u201d (v. 8-13,) there are some Judans who clearly do not appear to be deserving of harsh treatment. There apparently was a group of Judans that had maintained its faith and righteousness despite the corruption surrounding them: \u201cSeek the LORD, all you humble of the land who have fulfilled His law; seek righteousness, seek humility. Perhaps you will find shelter on the day of the LORD\u2019s anger\u201d (verse 3).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">A midrash insists that unlike when a flesh-and-blood king looks to put down a rebellion, he indiscriminately kills everyone, both the bad as well as the good, this is not the case with respect to the <\/span><em><span style=\"font-weight: 400;\">Bochein Levavot<\/span><\/em><span style=\"font-weight: 400;\"> (\u201cthe discerner of [thoughts within] hearts\u201d):<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">They said before Him: Master of the universe! A human king, against whom a province rebelled and ten or twenty of them cursed the king or his representatives, he sends against them his legions who carry out utter destruction and kill the good along with the bad, because he cannot discern who rebelled and who didn\u2019t.... But You, who knows the thoughts of man, what hearts and innards advise, and the desires of Your creatures, understands, and You know who has rebelled and who has not. You know the spirit of every individual. For this reason, the text states: (Bamidbar 16:22) \u201c\u2026God of the spirits of all flesh, if one person sins, will You be wrathful with the whole community?\u201d The Holy One, Blessed Be He, said to them: You have spoken well. I will make known who has sinned and who has not. (Bamidbar Rabba 18:11).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">So one can reasonably wonder why the survival of these righteous individuals was in doubt.<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">\u201cThe Lord will enter into judgment with the elders of His people and its princes (Isaiah 3:14) \u2026 The question arises: What did the elders, i.e., the sages of that generation, do that was considered a sin? \u2026 God will enter into judgment with the elders because they did not protest the sinful conduct of the princes (Shabbat 54b-55a).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Since it is possible to strive for improvement throughout one\u2019s life without ever feeling ready to confront evildoers, Zephaniah may be suggesting that while such individuals may not merit objective punishment, nevertheless, they failed to \u201cpull their weight\u201d within the society, implying that their achievements were more for themselves, than a benefit to everyone else. Second, I was struck by the fact that only four of the five Philistine cities are mentioned. The Philistines were organized into a pentapolis consisting (alphabetically\u2014in Hebrew) of Ashdod, Ashkelon, Gat, Gaza, and Ekron, and there are explicit references to \u201cthe five Philistine officers\u201d in the books of Joshua (13:3), Judges (3:3), and 1 Samuel (6:4,16). The anomalous absence of Gat from our verse invited comment.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It turns out that Radak anticipated these observations, writing:<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">\u201cGaza will be deserted\u201d: This is a form of flowery prose utilizing paronomasia, even though not all the letters match\u2026 \u201cEkron shall be uprooted\u201d: Paronomasia with a literary flourish. This description isn\u2019t just a nature film, but is also an abject lesson in the results of arrogance: \u201cIs this the gay city That dwelt secure, That thought in her heart, \u201cI am, and there is none but me\u201d? Alas, she is become a waste, A lair of wild beasts!
