It seems that similar to so many disputes that wars are fought over, the issue is one of land (<\/span><i><span style=\"font-weight: 400;\">see v. 13<\/span><\/i><span style=\"font-weight: 400;\">)\u2014to whom truly belongs real estate that had changed hands in the interim, ending up in the possession of the Israelites? Jephthah sends a message designed to head off the Ammonite army, but to no avail, and left with no choice, goes to war.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">What exactly did Jephthah communicate that fell on the Ammonite king\u2019s deaf ears? Jephthah\u2019s message consisted of five parts:<\/span><\/p>\r\n<ol>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A reprise of Israelite history, clearly indicating that the Ammonites had no present claim to the land (v. 16-23, paralleling Numbers 21:21-26; Deuteronomy 2:24-30);<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A rhetorical question: Since God was responsible for the Israelites winning the battles in the past and subsequently possessing the land, shouldn\u2019t they be allowed to hold onto it, just as you, the Ammonites, would think that whatever your god would \u201cgive\u201d you was destined for you to keep? (v. 24);<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Balak attempted to curse the Israelites via Balaam, rather than fight them; why are the Ammonites following a different tack? (v. 25);<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If three hundred years have elapsed since the time of the land\u2019s conquest and settling of the territory, why are they only coming now? (v. 26);<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Jephthah and his people have done no wrong - why are they making war? (v. 27).<\/span><\/li>\r\n<\/ol>\r\n<p><span style=\"font-weight: 400;\">Only the fourth point seems to imply that had the Ammonites come significantly earlier, perhaps their claim would have been taken more seriously by the Israelites. The first three statements as well as the fifth, give no indication of an outcome regarding the land other than what presently exists.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Assuming that the Ammonites are going to act like other nations throughout human history, for them to relinquish a claim that would expand their lands, makes it likely that whatever is said to them by the other side will be ignored. However, Jephthah tries his rhetorical best in order to spare both nations the deaths and injuries that warfare necessarily entails. He vows that the first thing that comes out of his house will be given as a burnt offering to God. Like Jacob\u2019s proclamation to Laban that doomed Rebecca (Gen. 31:32, 35:18), Jephthah\u2019s daughter is the first to come out to greet him. Based on Jephthah\u2019s promise, his daughter should have been sacrificed.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">What actually happened? When his daughter walks out, the text adds that \u201cshe was his only child, he had no other son or daughter\u201d (verse 35). This recalls the command of God to Abraham to take his son, his only son, that he loves, for the akedah, the binding of Isaac. On the one hand this could mean that he would have to sacrifice her. On the other hand, Abraham ultimately did not have to sacrifice Isaac.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Next, Jephthah tears his clothes and tells his daughter that he is upset because he made a vow and cannot retract it. Ripping clothes is connected to mourning. The implication is that he was \u201cpre-mourning\u201d his daughter\u2019s death. By stating that he could not go back on the vow it adds gravity of the situation. Some commentators pick up on this and chastise both Jephthah and Phineas for not getting together to have the vow annulled. Annulment is possible for most vows under halacha.\u00a0 As a result, both Phineas and Jephthah were punished. Phineas lost his prophetic vision and Jephthah had to sacrifice his daughter.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jephthah\u2019s daughter responds that Jephthah made a vow, so he should follow through because God kept His side of the bargain. She then asks for two months to go with her friends and \u201clament and bewail my maidenhood\u201d (verse 37). The midrash interprets this request as Jephthah\u2019s daughter taking matters into her own hands to find a legal loophole. Some commentators latch onto \u201cbewail my maidenhood\u201d as a hint from the text that she was condemned to a life of solitude and not that she was killed. She should have been lamenting her life, not her maidenhood.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Next, \u201cafter two months, she returned to her father, and he did to her as he had vowed. She had never known a man. So it became a custom in Israel for the maidens of Israel to go every year, for four days in the year, and chant dirges for the daughter of Jephthah the Gileadite\u201d (verses 39-40). It seems like Jephthah followed through with his oath, and as a result the date lived in infamy.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But, the text never directly mentions that he killed her. Some commentators focus on the second part. They explain that she was sent to a solitary life and was only allowed visits four days a year from other maidens, which is why this ceremony was mentioned. One\u2019s interpretation of the story hinges on whether the text is using euphemisms to avoid the taboo topic of child sacrifice, or whether the end result was really something less It was an ambitious work (so ambitious that the artist never managed to fully complete it to his liking) which attempted to pour all of the pathos of the Biblical tale into one tragic moment. Unlike many other depictions of the story, Degas drew Jephthah at the very instant when he realizes the coming calamity \u2013 that it was his daughter who was the first to come first out of his house, and thus it is she who must be offered in sacrifice. Across the frame, we see Jephthah\u2019s daughter, who strangely enough already seems aware that her fate is sealed. Even more unusually, she is surrounded by a group of girls who are already mourning with her \u2013 \u201cthe maidens of Israel to go every year, for four days in the year, and chant dirges for the daughter of Jephthah the Gileadite (Judges 11:40).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It is not clear why Degas collapsed the tragedy of this story into a single frame. But to this viewer, the painting perfectly captures the sense of foreboding in this chapter. In so doing, he made a vow: \u201cIf [God] will deliver the Ammonites into my hands, whatever comes out of the door of my house to greet me when I return, whole, from Ammon, will belong to the Lord; I will offer it as a sacrifice\u201d (30-31). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The upshot is that he is greeted by his daughter, an only child (34).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">While we are told three things about her; namely, \u201cshe never knew a man,\u201d \u201cshe became an ordinance (<em>c<\/em><\/span><em><span style=\"font-weight: 400;\">hoq<\/span><\/em><span style=\"font-weight: 400;\">) in Israel,\u201d and \u201cfor four days a year, Israelite maidens would lament her\u201d (39-40), her actual fate is unclear. The Talmud and Midrash described Jephthah\u2019s vow as \u201cinappropriate\u201d (<\/span><em><span style=\"font-weight: 400;\">shelo ke-hogen<\/span><\/em><span style=\"font-weight: 400;\">) and maintained that he was obliged to sacrifice his daughter. They also addressed the question of why he did not simply annul his vow. Since only the high priest can annul the vow of a ruler, they posited a standoff between Jephthah and Phineas, neither of whom would defer to the other (Taanit 4a; Bereishit Rabba<\/span> <span style=\"font-weight: 400;\">60:3).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This view held sway until the 12th century, when an alternative interpretation was advanced. Abraham Ibn Ezra (cited by Nac\u1e25manides to Leviticus 27: 29) specified that Jephthah\u2019s vow was to be parsed as follows: \u201cWhatsoever emerges from my doorway \u2026 will be dedicated to God, OR offered as a sacrifice\u201d (31). Rather than sacrifice his daughter, Jephthah had her secluded and she remained a virgin her entire life. Perhaps he was swayed by regional cultural norms of battle-vows attested also in ancient Greece (cf. the stories of Idomeneus of Crete or Meander) and or the corrosive norms of Canaanite culture, as proposed by<\/span><a href=\"https:\/\/www.etzion.org.il\/en\/shiur-09-chapter-11-conclusion-yiftachs-vow\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">Rabbi Michael Hattin<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Or perhaps Jephthah let his sudden rise to power go to his head, and cloud his judgment. When the story begins, Jephthah, an illegitimate son, has been ignominiously banished by his half-brothers, and is living beyond the borders of the family territory and also outside of the law. But when the Gileadites are in serious trouble and need a leader who can get things done, Jephthah\u2019s their man. He calls on God to witness the terms of his engagement and gets to work.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">He tries negotiating with the enemy but recounting Biblical history does not inspire the Ammonite leaders to compromise what they consider their own interests. Jephthah prepares for war. Confident in the righteousness of his cause, and certain that God is with him, he takes the fateful vow. What could go wrong? Nothing, Jephthah assures himself: \u201cGod is with God\u2019s people, God is on my side, all will be well.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">God is indeed with God\u2019s people, and they are victorious over the Ammonites. But Jephthah soon learns that his self-confidence was misplaced. His daughter, his only child, eager to celebrate her father\u2019s and her people\u2019s triumph with music and dancing, rushes out to greet him (vv. 33-34), and everything comes crashing down.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jephthah is guilty of hubris, excessive pride and arrogance before God. He pushed God\u2019s hand, if it may be said, with rash words, and learns the limit of his power. For the public good, God seemingly acquiesces to the vow, but will not reward an attitude of \u201ceverything will be okay,\u201d by ensuring that Jephthah is met first by a sheep or goat. With each subsequent deliverer the narrative of that period is conspicuously absent of information about the ongoing leadership of the judge during the years of tranquility.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Beginning in chapter 8, when the Israelites appealed to Gideon to begin a monarchic line of leadership, we get a sense that the Israelites were searching for stability after these ever-repetitive cycles of tranquility, oppression and deliverance. But for now, in chapter 11, they seem to be reverting to their established protocol as they propose Jephthah as a purely military leader with the plea \u201cBe our captain, that we may fight Amon.\u201d But Jephthah wants more than that. \u201cIf I lead you in battle and you are delivered\u201d, Jephthah negotiates, \u201cthen you need to make me your head.\u201d Did Jephthah recognize that the Israelite model of leadership was on the cusp of changing, or is his counter-proposal a sign of a character flaw that will shortly become painfully evident? Did Jephthah understand where his skill-set lied and where it did not?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Harav Moshe Lichtenstein, in his Sicha \u201cYiftach: The Right Man at the Wrong Time\u201d posits that within Jephthah\u2019s response to the call for leadership lies evidence of his impending downfall. Jephthah may have been well-suited to be a \u201ccaptain\u201d \u2013 a deliverer, with battlefield traits of laser-focused determination and an obstinate adherence to rule and order. And his commitment to God was evident in his vow to make an offering of the first thing he sees should he return home victorious. But then Jephthah\u2019s daughter greets his return and Jephthah insists that his vow be applied to the letter.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Had Jephthah appreciated his own strengths and weaknesses, and allowed for the consideration of other ideas, the consequence would not have been so disastrous. A modicum of regret, flexibility, the wisdom to seek counsel and appreciate contextual nuances would have served to allow the nullification of Jephthah\u2019s vow and save his daughter. Gilead later marries and has other children. When those children are grown, they chase Jephthah away, saying \u201cYou shall have no share in our father\u2019s property, for you are the son of an outsider\u201d (11:2). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But when the Ammonites come to attack the land of Gilead, its elders beg Jephthah to return. Jephthah rebuffs the elders, saying \u201cYou are the very people who rejected me\u2026. \u00a0How can you come to me now when you are in trouble?\u201d (11:7). The elders then offer Jephthah leadership over their land, and Jephthah assents. Jephthah defeats Ammon, achieving a victory that is both political and personal, as he has risen from the son of a harlot to become the leader of Gilead. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But he issued an oath before the battle, vowing to sacrifice to God whatever first comes out of his house after the battle. Disastrously, he is met by his daughter. And the tragedy is complete because, as the verse continues, \u201cshe was an only child (<\/span><em><span style=\"font-weight: 400;\">yechidah<\/span><\/em><span style=\"font-weight: 400;\">); he had no other son or daughter.\u201d In his rashness, then, Jephthah has not only doomed his daughter but ended his line. \u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Focusing on the rise and fall of Jephthah\u2019s status offers a new understanding of Jephthah\u2019s cry at the story\u2019s end: \u201cAlas, daughter! \u2026 I have uttered a vow to the LORD, <\/span><em><span style=\"font-weight: 400;\">velo uchal lashuv<\/span><\/em><i><span style=\"font-weight: 400;\">\u201d<\/span><\/i><span style=\"font-weight: 400;\"> (11:35). This last phrase is commonly translated as \u201cand I cannot <\/span><b>retract<\/b><span style=\"font-weight: 400;\"> [my vow].\u201d \u00a0But the more<\/span> <span style=\"font-weight: 400;\">literal translation of the phrase yields a new and deeper meaning: \u201cand [now] I cannot <\/span><b>return<\/b><span style=\"font-weight: 400;\">,\u201d meaning that\u2014with no child to inherit him\u2014the birthright of Gilead must pass back to his half-brothers and their descendants. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Underneath the drama, this story probes a societal fault line. In the polygamous world of ancient Israel, there would have been major tensions among wives over inheritance. The eldest son of the first wife could rightfully claim to be his father\u2019s first. But when a man took a subsequent wife he often promoted her to a position of primacy. The eldest son of this later wife could claim to be from his father\u2019s favorite. The Bible visits this struggle repeatedly, with God recognizing the preferred wife\u2019s children as deserving the birthright. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Much like a Greek tragedy, the story of Jephthah demonstrates that fate cannot be thwarted. \u00a0Even when the first-born son successfully wins the birthright on the battlefield, he will still be disinherited and the After his half-brothers reject him, denying him any share in the inheritance of their common father, Jephthah goes off to the Land of Tov, where he gathers about him a gang of good-for-nothings (vv. 2-3). When the Ammonites attack Israel, the elders of Gilead go to Jephthah and beg him to be their commander in their war with the Ammonites (verse 4). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Before Jephthah advances against the Ammonites, tragically, he makes his well-know vow to God. After defeating the Ammonites, when Jephthah returns to his home, he is met by his daughter, \u201cdancing to the sound of timbrels\u201d. When Jephthah sees her, he tears his clothes and cries out: \u201cOh no, my daughter! I have made a vow to the Lord that I cannot break\u201d. \u00a0She replies: \u201cMy father! \u2026 Do to me just as you promised \u2026But grant me this one request. Give me two months to roam the hills and weep with my friends, because I will never marry\u201d. She and her friends go into the hills and weep because she would never marry. After the two months, she returns to her father, and he sacrifices her as he had vowed. And from then on, the young women of Israel go out for four days each year to commemorate the daughter of Jephthah (verses 34-40).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">According to the first-century CE Jewish text, Biblical Antiquities (Pseudo-Philo), Chapters 39-40, God was very angry at Jephthah, saying: \u201cIf a dog had met Jephthah first, would he have offered a dog to Me?! His punishment will be that he will indeed slaughter his own only child.\u201d <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">According to this text, Jephthah\u2019s daughter is named Seila, and to her is attributed a long poem of lamentation over her impending death. The Midrash (Tanhuma Buber, Behuqotai 7) further condemns Jephthah as having been unaware of the halakhah permitting revocation of rashly made vows (see Mishnah Nedarim, Chapter 9). After having argued with her father, Jephthah\u2019s daughter petitions the Sanhedrin in her day to release her father, Jephthah, from his vow, but they do not find sufficient warrant to do so. Jephthah vows to sacrifice whatever or whoever comes out of his home to greet him after battle in order to win a victory against the Ammonites. When his nameless daughter greets him with timbrels and dance, <\/span><em><span style=\"font-weight: 400;\">as she is expected to do after her father wins a military victory<\/span><\/em><span style=\"font-weight: 400;\">, he laments his rash vow but carries out her murder nonetheless. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The author clearly wants to convey disgust with Jephthah\u2019s actions. The first description we have of Jephthah is a judgment of the morality practiced in his family\u2019s home: he is the son of a <\/span><em><span style=\"font-weight: 400;\">zona<\/span><\/em><span style=\"font-weight: 400;\">, a whore. Today, I would hope, we understand that women who choose to engage in sex work of their own free will <\/span><em><span style=\"font-weight: 400;\">and<\/span><\/em><span style=\"font-weight: 400;\"> women who are forced into the sex work industry without their consent are all able to live moral and ethical lives, despite what judgments society may make on their profession. Our text, however, assumes that Jephthah grew up in the house of his father, a man who bought a woman\u2019s body, impregnated her, raised the child, and allowed his other \u201clegitimate\u201d children to torment him so much so that he had to flee. Our text uses Jephthah\u2019s parentage as a judgment on his family\u2019s morality; a family that engages in immoral behavior will promote immoral behavior.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jephthah\u2019s may be a good warrior, but our narrator indicates that he is a morally questionable man. So when Jephthah makes his vow to sacrifice whatever comes forth from his house when he returns from battle, we should read this with misgivings. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">I refuse to believe he did not know how likely it would be that his daughter would come out to greet him ritually. Either Jephthah knew how probable it was that he would have to sacrifice a woman, or he was so arrogant and inconsiderate of women to not know their ritual role in welcoming soldiers home from battle. We are meant to see his misogyny as a moral failure.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The fact that <\/span><em><span style=\"font-weight: 400;\">bat-Jephthah<\/span><\/em><span style=\"font-weight: 400;\"> is given no name, that the only thing we know about her is her relationship to men, only highlights the misogyny present in this story. She may be <\/span><em><span style=\"font-weight: 400;\">y\u2019chidah<\/span><\/em><span style=\"font-weight: 400;\">, his only, but she is not <\/span><em><span style=\"font-weight: 400;\">ahuvah<\/span><\/em><span style=\"font-weight: 400;\">, beloved. She is not even deserving of a name. Jephthah\u2019s misogyny, inherited from Gilead his father, leads him to one of the most horrifically immoral acts in our Tanakh, child sacrifice. It is obvious, even until today, the ways in which misogyny leads to the murder and the dehumanization of women. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The story of Jephthah\u2019s daughter is a warning to us. Jephthah\u2019s name, <\/span><i><span style=\"font-weight: 400;\">Yiftah<\/span><\/i><span style=\"font-weight: 400;\">, means \u201che opens.\u201d The verb used here, <\/span><i><span style=\"font-weight: 400;\">patsah<\/span><\/i><span style=\"font-weight: 400;\">, is slightly different than the verb <\/span><i><span style=\"font-weight: 400;\">patah<\/span><\/i><span style=\"font-weight: 400;\"> on which the name is based, but it is a close phonetic and semantic cousin. That\u2019s the message from the beginning of the book (verses 1-14) about Jephthah\u2019s leadership. If there had been an alternative, the elders of Gilead wouldn\u2019t have turned to him in the first place, or acceded to his demand to lead the people beyond the military aspects.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">Regards from Balak<\/span><\/i><span style=\"font-weight: 400;\">. Who becomes here a sort of historical precedent. Jephthah gives the Ammonites, and their king, a history lesson, to dissuade them from attacking the Israelites. Even Balak, he says, who had plenty to say about us, didn\u2019t start up with us: \u201cBesides, are you any better than Balak son of Zippor, king of Moab? Did he start a quarrel with Israel or go to war with them?\" (verse 25).<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\"><i><span style=\"font-weight: 400;\">What have you done to me?? <\/span><\/i><span style=\"font-weight: 400;\">That\u2019s basically what Jephthah says to his daughter, in his cri de coeur in verse 35.
