The Josephites complained to Joshua, saying, \u2018Why have you assigned as our portion a single allotment and a single district, seeing that we are a numerous people whom the L<\/span>ORD<\/span> has blessed so greatly?\u2019 (verse 14).\u00a0<\/span><\/p>\r\n

Why did the Josephites complain? And who were the Josephites?\u00a0<\/span><\/p>\r\n

Rashi explains that really only the tribe of Menashe complained. Back in Deuteronomy, God told Moses to assign portions of the land to each tribe by size. According to Rashi, that size was based on the population in the wilderness. Ephraim\u2019s population subsequently decreased, so the tribe received more land than population and had no reason to complain. Menashe\u2019s population, on the other hand, exploded. They gained the most number of people- over 20,000.\u00a0<\/span><\/p>\r\n

They went to Joshua to complain because the original allotment was too small. The issue with Rashi is that if the areas were predetermined back in Deuteronomy, what was the point of the lottery?\u00a0 Radak inferred from here that each tribe received the exact same land size in even slices. But his interpretation does not match the geographical layout of the assigned cities. Perhaps Menashe was concerned that their tribe would continue to increase exponentially. Therefore, while they received a large territory now, the land would not be large enough for the future.\u00a0<\/span><\/p>\r\n

Joshua's answer in the next verse is a good example of his evolution as a leader. After the Israelites lost the first battle of Ai, Joshua fell on his face and prayed to God. God responded that it was not time to fall down and that Joshua should just go up and attack the city again. Joshua\u2019s response to the Josephites is the same:\u00a0 \u201c\u2019If you are a numerous people,\u2019 Joshua answered them, \u2018go up to the forest country and clear an area for yourselves there\u2026\u2019\u201d If you want more land, then go take it yourself! Why are you complaining to me. Joshua does not have patience for complainers when so much of the land was still unconquered.\u00a0<\/span><\/p>\r\n

It is a truth universally acknowledged that a good story has a beginning, a middle, and an end. The opening sets the scene: eighteenth-century English country house estates perhaps, or a charming shtetl in Tsarist Russia. We meet the characters: five sisters on the cusp of womanhood, a father with five daughters of marriageable age \u2013 protagonists of both Jane Austen\u2019s <\/span>Pride and Prejudice<\/span><\/i> and <\/span>Fiddler on the Roof<\/span><\/i>. But, as Shakespeare reminds us in <\/span>A Midsummer Night\u2019s Dream<\/span><\/i>, \u2018the course of true love never did run smooth\u2019. The middle of the story brings tension, action, drama, an insurmountable problem of cosmic proportions. The younger generation revolts against their parents\u2019 ways: daughters refuse to marry the man their father found for them, each declining to settle for a husband she knows is not right for her. Yet both these stories end with a resolution of sorts. The daughters make their choices, and their parents must live with their decisions, even if it means never speaking to their daughters again.<\/span><\/p>\r\n

Long before these stories, there was another family of five daughters: Mahlah, Noah, Hoglah, Milcah and Tirzah. We first meet these sisters in the Book of Numbers, as the people of Israel dwell in the wilderness. Just like the Bennet sisters and Tevye\u2019s daughters, the daughters of Zelophehad challenge their community\u2019s rules for young women. As they have no brothers, they are not entitled to inherit their late father\u2019s land. Yet they approach Moses, who does not immediately acquiesce to their request to inherit from their father, but consults with God, who agrees with the sisters. Thus the law is changed, and even though a couple of chapters later it is refined to restrict female heirs to marrying within their father\u2019s tribe, the entitlement of Zelophehad\u2019s daughters to inherit their father\u2019s land remains.<\/span><\/p>\r\n

And yet the Torah gives us only the beginning, and the middle. For the ending of the story, we need to wait until deep in the Book of Joshua. Here, the people of Israel are no longer wandering in the desert. They have finally arrived in Canaan, the promised land. And Joshua, who has succeeded Moses as the leader of the Israelites, divides the land between the tribes. It is finally time for the daughters of Zelophehad to receive their inheritance. Yet, they have to ask for it. They approach Eleazar the Priest, Joshua, and the princes, explaining that \u2018God commanded Moses to give us an inheritance among our brothers\u2019 (Joshua 17:4). And thus, they are granted a portion of land belonging to Manasseh\u2019s tribe.<\/span><\/p>\r\n

The ending of a story is not always satisfying. It is gratifying to read that the daughters of Zelophehad finally receive what God promised to them. Realising that they had to ask for it \u2013 more than once \u2013 is far less pleasant. Yet, the ending of Mahlah, Noah, Hoglah, Milcah and Tirzah\u2019s story remains inspirational. <\/span><\/p>\r\n

In the words of Theodor Herzl: \u2018If you will it, it is no dream\u2019.<\/span><\/p>\r\n

Remember all the way back to the Book of Numbers (chapters 27 and 36)? In the midst of a theoretical discussion of how the Land of Israel would be divided when and if the tribes inherited it, it became apparent that inheritance would pass only through male heirs. One righteous man, Zelophehad, had no sons, but he did have five righteous daughters who seem to have inherited not only his righteousness, but also a propensity to stand up for their own rights. Into that male club of decision makers, these bold women intruded themselves and asked a simple question: is it right for our father\u2019s inheritance to disappear simply because he has no sons? And Moses, after consulting with God, returns the answer: no, that would be wrong.<\/span><\/p>\r\n

Case closed, no? Well, actually, no. Anyone who has ever been involved in prolonged negotiations or even conflict know that the matter isn\u2019t solved when the decision is rendered. The matter is concluded only when that decision is implemented. Justice promised isn\u2019t justice at all. Justice enacted is the only justice there is.<\/span><\/p>\r\n

Small wonder, therefore, that we have a second act for these righteous, pushy women. Now, in the middle of the Book of Joshua, the conquest of the land newly achieved, Joshua turns to the business of dividing the land among the tribes of Israel. As he is distributing the land according to tribal size, clout, and inheritance, who shows up but the feisty contentious ladies? The daughters of Zelophehad, now listed in a slightly different order, return to see that the inheritance promised them is now delivered.<\/span><\/p>\r\n

Why are they listed in a slightly different order? One authority says that the first list presented them in order of wisdom, and the current list presents them in order of age. But I prefer Rashi\u2019s insight. He says they are listed in different orders to teach that they are each of equal worth (Rashi to Numbers 27:1).<\/span><\/p>\r\n

They are indeed of equal worth: these five heroes move our sense of dignity and equality one step forward. It may seem a small step in the light of the next few thousand years looking backward, but looking from where they stood, the shift was unprecedented (in two ways: it had never happened before, and there was no precedent to rely on). Moses and God just knew it was right, so the law had to shift. \u00a0<\/span><\/p>\r\n

We stand on the strong shoulders of Zelophehad\u2019s loud daughters. And on the shoulders of Moses and Joshua who understand that law advances not merely by applying older rules to newer situations, but by locating where justice lies and then interpreting the law in such a way that the more moral outcome emerges, and is implemented.<\/span><\/p>\r\n

Toward the end of the Book of Numbers, Moses (along with Elazar the Priest and the tribal princes) was confronted by the five orphaned daughters of Zelophehad who demanded their fair share of the territory that was allocated to their late father. Moses submitted their case before God Who found in their favor\u2014providing for the distribution of inheritance to daughters in the absence of sons (Numbers 27:1 ff.). At the book\u2019s very end (which happens to coincide with the end of the forty years\u2019 wandering in the wilderness), the incident is reprised with the additional information that they married cousins (37:11) thereby keeping their inheritance all in the family, so to speak, which meant the tribe of Manasseh.<\/span><\/p>\r\n

This incident was a defining moment in Torah law as a rare decision in a matter we would call \u201cwomen\u2019s rights.\u201d Suffice it to say in this context that the Sages did not regard these women as protestors and social activists, describing them instead as \u201cwise, lawyerly, and virtuous\u201d (<\/span>hakhamot, darshaniyot, tzidkaniyot<\/span><\/i>; Baba Batra 119b).<\/span><\/p>\r\n

In the current chapter, the case reaches its fruition as the women approach Joshua (along with Elazar the Priest and the tribal princes) and the earlier divine verdict was implemented in practice: \u201cAnd he gave them inheritance among their uncles\u201d (v. 4). Interestingly, while this ends the biblical story of Zelophehad\u2019s daughters, it has an extra-biblical epilogue.<\/span><\/p>\r\n

A place named Tirzah is mentioned in the Tanakh as the first capital of the northern kingdom, which, presumably, would locate it in the proximity of the later capital, Samaria (Shomron). In 1910, the archaeologist Gerhard Reisner found some sixty inscribed potsherds that have come to be known as \u201cThe Samaria Ostraca.\u201d Dated to the end of the 8<\/span>th<\/span> century BCE (around the time of King Ahab of Israel), they served as commercial records. Thirty of them contain names of nearby clans or districts of the tribe of Manasseh, including one place named Haglah and another named No`ah\u2014evidently after two of Zelophehad\u2019s daughters.<\/span><\/p>\r\n

The text balances the dull and dry boundary descriptions with a colorful personal component, in which women are featured with unusual prominence. <\/span><\/p>\r\n

In the case of Judah, the text incorporated the bittersweet reminiscences of Caleb son of Yefuneh and the efforts of Akhsa his daughter to secure springs of water (15:18-19). The text relates that Otniel, Akhsa\u2019s husband, was a capable warrior but was reluctant to press their claim to the springs, and only did so after being urged along by his able and ambitious wife! The implication is clear: While the warrior men of Israel did not shirk their responsibility to wrest the land from the grip of the Canaanites, the task of settling it was embraced by Israel's industrious women, whose love for Canaan was no less ardent. <\/span><\/p>\r\n

For Joseph, the warrior of note is Makhir son of Menashe. His exploit, recalled in Joshua 17:1, resembled the triumph of Otniel over the giants of Kiryat Sefer. The analog to Akhsa is provided by the five daughters of Zelophehad, spirited women all, who determinedly secure for themselves in perpetuity their deceased father's tribal portion in the land (17:3-4). <\/span><\/p>\r\n

In both narratives, that of Judah as well as that of Joseph, the text pointedly indicates that the women demonstrated a sincere attachment to the land and a willingness to overcome obstacles in order to secure their place in it. In both stories these women were singled out by name, a fact that may come to emphasize the glaring difference between military triumphs on the one hand and settlement on the other, the twin pillars of the Book of Joshua as a whole. While the former is secured by anonymous masses of fighting men that triumph precisely because of the suppression and sacrifice of their individuality for the common good, the latter can only be achieved by specific personalities brave enough to clear and work their particular plot of land in order to build their own homes and raise their own families upon it. <\/span><\/p>\r\n

In the biblical world, the woman or mother figure takes responsibility for the care of the house and the nurturing of the children, while warfare is undertaken by the man. In the end, the contribution of both is essential for the overall success of the endeavor, and the accounts of Judah and Joseph therefore mention both. <\/span><\/p>\r\n

In verse 1 we meet Manasseh\u2019s first born, Machir, who heads the dominant family in Gilead: \u201cSince Machir, the first-born of Manasseh and the father of Gilead, was a valiant warrior, Gilead and Bashan were assigned to him.\u201d<\/span><\/li>\r\n\t
  2. The promise and its fulfillment<\/span><\/i>. The fulfillment of the promise made to the daughters of Zelophehad back in Numbers is phrased in terms that are reminiscent of the promise itself. Here, in verse 4: \u201cThey appeared before the priest Eleazer, Joshua son of Nun, and the chieftains\u2026\u201d; there (Numbers 27:1-2), they appeared before Moses and the chieftains\u2026<\/span><\/li>\r\n\t
  3. Complaints - and low marks<\/span><\/i>. The complaints of the Josephites who had trouble conquering their portions, and griped that they were deprived (verses 12-18), is presented in contrast to the tenacious valor and stalwart dignity of Caleb, of the tribe of Judah, in acquiring his portion (chapter 14).
