Faced with an ascendant Israelite army the Gibeonites, inhabitants of a few cities on the way to Jerusalem, try a little trickery of their own. They disguise themselves as foreigners and ask Joshua for a peace treaty. Without consulting God, Joshua and the people agree. When it is quickly revealed that the Gibeonites were in disguise, Joshua is stuck. On the one hand, the Israelites were instructed to wipe out the seven nations. On the other hand, they had just entered into a peace treaty. Reneging on the peace treaty would also be an affront to God. The compromise is that Gibeonites are to remain a lower caste responsible for water carrying and woodchopping.\u00a0<\/span><\/p>\r\n

Later on in the book of Ezra (8:20), the Gibeonites are referred to as the <\/span>netinim<\/em> <\/span>\u201cand of the <\/span>netinim<\/em> <\/span>whom David and the officers had appointed for the service of the Levites\u2014220 temple servants, all of them listed by name.\u201d They were called the <\/span>netinim<\/em> <\/span>because they were given over (<\/span>netunim<\/span><\/em>)\u00a0 to the Temple service. Their reappearance in the book of Ezra also indicates that the Gibeonites upheld their end of the bargain through the centuries and were committed enough to return with the few exiles to help build the Second Temple.\u00a0<\/span><\/p>\r\n

The compromise with Joshua also created a new \u201ccategory\u201d of Jewish law relating specifically to the Gibeonites. Deuteronomy 23 mandates that someone from Ammon and Moab can never marry into the Israelites nation, and someone from Edom and Egypt must wait three generations. The Talmud in Yevamot 79a explains that Joshua decreed that the Gibeonites are also forbidden to marry into the Israelite nation as they were designated as slaves to the Temple (or Mishkan at that time). This is derived from verse 27: \u201cThat day Joshua made them hewers of wood and drawers of water\u2014as they still are\u2014for the community and for the altar of the L<\/span>ORD<\/span>, in the place that He would choose.\u201d\u00a0<\/span><\/p>\r\n

The Shulchan Aruch also includes the Gibeonites in its hierarchy of charity:\u00a0<\/span><\/p>\r\n

If many poor seek help and there is not enough money in the treasury to help them all, a priest is given preference before a Levite; a Levite before an ordinary Israelite; an Israelite before a Halal; a Halal before a child of unknown fatherhood; such a one before a child of unknown parents; a child of unknown parents before a bastard; a bastard before a Netin, a Netin before a proselyte; a proselyte before an emancipated slave.<\/span><\/p>\r\n

It is rare for an entirely new law to appear in the Prophets, but Joshua\u2019s edict created a compact that lasts, theoretically, to this day.<\/span><\/p>\r\n

Fearing for their lives, the Gibeonites realized that military resistance to the Israelites would be futile and attempted to preserve their cities through guile. What is more puzzling is Joshua\u2019s initial surprise at the Gibeonites\u2019 conduct. After all, if the threat of death was indeed suspended over them as ominously as they said, isn\u2019t their duplicity perfectly intelligible? <\/span><\/p>\r\n

Joshua\u2019s bewilderment provides indirect support for the rabbinic tradition first mentioned in the Jerusalem Talmud and adopted by many of the later authorities:<\/span><\/p>\r\n

Joshua sent three proclamations to the inhabitants of the land of Canaan, before the people of Israel entered the land. The first stated: \u201cWhosoever wants to leave, let him do so.\u201d The second stated: \u201cWhosoever wants to conclude peace, let him do so.\u201d The third stated: \u201cWhosoever wants to wage war, let him do so. The Girgashites decided to evacuate... to Africa, the Gibeonites concluded peace, and the other thirty-one kings of Canaan waged war and were defeated\u201d (Y. Shevi\u2019it 6:1).<\/span><\/p>\r\n

If in fact the Gibeonites had been offered the possibility of surrendering peacefully, why did they risk arousing the wrath of their vanquishers by securing their survival through deception? <\/span><\/p>\r\n

Recall that the narrative of the Gibeonites is introduced by the assertion that all of the Canaanite kings had decided to battle Israel as one (Josh. 9:1-2). Recall, also, that the verses in chapter 11 pointedly indicate that only the Gibeonites, of all of the land's inhabitants, sued for peace. Finally, note that in the aftermath of the Gibeonite treaty struck with Israel, the southern kings launched a punitive assault against the towns of Gibeon (10:1-5), which was ultimately repelled by an unexpected Israelite counterattack. <\/span><\/p>\r\n

The implication of these citations is clear: The greatest impediment to the adoption by the Gibeonites of more honest methods was the unified Canaanite front that opposed any compromise with the Israelites. The town of Gibeon was forced to adopt subterfuge in order to avoid arousing the ire of the other Canaanite kings who would have opposed such an overture of peace. The Gibeonites thus sent their emissaries secretly and in disguise. Once they were in possession of the precious Israelite pledge of support, they discarded the pretense. The Canaanite attack was indeed forthcoming, but so was the Israelite defense. Had the Gibeonites sued for peace openly, they would have been attacked and overwhelmed by their countrymen long before Joshua and the Israelites might have come to their aid. <\/span><\/p>\r\n

\u201cYehoshua ben Perachia says: Make for yourself a teacher, acquire for yourself a friend, and judge every person favorably.\u201d (Pirkei Avot 1:6)<\/span><\/p>\r\n

Here they stand before Joshua, with their tumbledown clothes, their splintered wineskins, their crumbs.<\/span><\/p>\r\n

\u201cThis is all that\u2019s left,\u201d they say, \u201cfrom our long journey. We\u2019ve heard about you. About your God. We will work for you. All we want,\u201d they say, \u201cis peace.\u201d<\/span><\/p>\r\n

Joshua\u2014 skeptical, cautious\u2014 surveys the scene. \u201cWhat would Moses do?\u201d he asks himself, attempting to exhibit strength while continuing to fight off his virulent bout of \u201cImpostor\u2019s Syndrome\u201d.<\/span><\/p>\r\n

\u201cOK,\u201d Joshua says, finally, with more than a trace of trepidation in his voice. \u201cWe take you at your word. We will make peace with you.\u201d<\/span><\/p>\r\n

Stunned, thrilled, the Gibeonites returned home\u2014 indeed a short journey\u2014 to tell the others, and to feast. \u201cWe are safe,\u201d said one to another. \u201cWe need not fear the fate of Jericho and Ai.\u201d<\/span><\/p>\r\n

For three days the Gibeonites reveled and made merry. For three days they ate their fill, drank, indulged.<\/span><\/p>\r\n

On the third day, Joshua and the Israelites set out\u2026<\/span><\/p>\r\n

At first, they only heard. It started with a faint hum. Then it grew to a buzz. Then commotion. Finally, Joshua and his people arrived at the camp and saw the Gibeonites in their glee. Here they stood, the same people who only days earlier looked like they were on the brink.<\/span><\/p>\r\n

Internal, infernal rage threatened to swallow Joshua, though he knew he couldn\u2019t show it. Slowly, nervously, Joshua\u2019s men turned to him: \u201cWhat next, Joshua? What are we going to do to them? They deceived us!\u201d<\/span><\/p>\r\n

\u201cAn oath is an oath,\u201d said Joshua. \u201cAn oath is an oath\u2026\u201d<\/span><\/p>\r\n

Joshua 9 tells the story of how Canaanite inhabitants of Gibeon, terrified by the Israelite destruction at Jericho and Ai, set out to trick Joshua into making a covenant. Gibeon has been identified with the modern site of Tell el-Jib since the Middle Ages. This identification was confirmed by the discovery of more than fifty jar handles with the name Gibeon (<\/span>gb\u02c1n<\/span><\/i>) inscribed in Hebrew letters. The letters <\/span>bet, ayin<\/span><\/i>, and <\/span>nun<\/span><\/i> from Gibeon, are visible at the top of this handle.<\/span><\/p>\r\n

In this chapter, we meet the inhabitants of Gibeon, a place not too distant from present-day Jerusalem, whose inhabitants hoodwinked the Israelites into coming to peaceful terms with them. By falsely giving the appearance of distant travelers (such as by carrying moldy bread, v. 12), they got Joshua and the elders to make a covenant with them. When the Israelites discovered the truth, however, they did not renege on their agreement granting them protection from any harm (19). Rather, they came up with the stratagem of declaring them to be \u201chewers of wood and drawers of water\u201d (21)\u2014permanent public servants\u2014which they remained \u201cto this very day\u201d (29).<\/span><\/p>\r\n

The obvious question (which, to be honest, we might have raised already apropos of 4:9, 5:9, 6:25, 7:26, and 8:28,29) is, to which \u201cvery day\u201d (<\/span>hayom hazeh<\/span><\/em>) is the verse referring? Don Isaac Abrabanel (1437-1508) devoted an extensive analysis to this question, arriving, in the process, at a highly unorthodox conclusion. Citing these and other examples in the introduction to his commentary on the Book of Joshua, he dismissed the talmudic implication that the words were written by Joshua himself because such notice is pointless when the narration follows so closely upon the events themselves. Rather, he maintained that the Book of Joshua, along with the Book of Judges and the Book of Samuel, were all written later (by which he could have meant edited) by the Prophet Samuel, which would put an appreciable amount of time between the actual occurrences and the telltale \u201cto this very day.\u201d<\/span><\/p>\r\n

Our chapter relates the story of Joshua and the Gibeonites. After the destruction of Jericho and Ai, the Israelites were commanded to destroy all the inhabitants of Canaan (Joshua 9:24). The people of Gibeon (a Canaanite city ten kilometers northwest of Jerusalem, today identified with the Palestinian village of Al-Jib) heard of this plan. To avoid being wiped out, they sent ambassadors to trick Joshua and the Israelites into making a treaty with them. The Gibeonites presented themselves in worn out clothing and footwear as ambassadors having come from a far distant land. Without consulting God, Joshua entered into a peace treaty with them (Joshua 9:14). Subsequently, the Israelites discovered that the Gibeonites were living just a three day walk from them (Joshua 9:17). Joshua then realized that he had been deceived. However, he kept the covenant with the Gibeonites and let them live in exchange for their servitude, declaring them to be hewers of wood and drawers of water for all time (Joshua 9:3-27).<\/span><\/p>\r\n

According to Jewish tradition (see Ginzberg, Legends of the Jews, \u201c[Joshua] Conquest of the Land\u201d), before Joshua set out on his campaign, he had issued three proclamations: 1) that any nation that would leave Canaan might depart unhindered, 2) that any nation that was willing to make peace with the Israelites should do it at once, and 3) that any nation that would choose to engage in war with the Israelites might do so. So, if the Gibeonites had simply sued for peace with the Israelites, when they heard this proclamation, there would have been no need for them to trick Israel into making a treaty with them. <\/span><\/p>\r\n

In the end, Joshua kept his promise not to destroy them, so as to sanctify the name of God, by showing the world how sacred an oath is to the Israelites. Because of their subterfuge, the Gibeonites were deemed not deserving of being absorbed into the Israelite nation. But rather they became a servant caste: \u201cThat day Joshua gave them to be hewers of wood and drawers of water\u2014as they still are\u2014for the community and for the altar of the Lord, in the place that He would choose\u201d (Joshua 9:27). \u00a0This chosen place was Jerusalem. According to Ezra 8:20, David \u201cgave\u201d the Gibeonites to serve the Levites in the First Temple. <\/span><\/p>\r\n

Here, and elsewhere, the Gibeonites are referred to as Netinim, because Joshua had \u201cgiven\u201d (natan) them to be hewers of wood and drawers of water. According to the Mishnah (Kiddushin 4:1) these Netinim, though living in the Israelite community, where they worked as Temple servants, were not allowed to intermarry with legitimate Israelites.   1. Intimate knowledge<\/span><\/i>: The Gibeonites demonstrate intimate knowledge, not just in Biblical law, but also in the history of the Israelites (vv. 9-10).

Who\u2019s in charge here?<\/span><\/i> In this chapter we hear many voices: Joshua, the chieftains, other Israelites, speaking alternately and sometimes together: So who is running the negotiations with the Gibeonites? Who doubts them, and who believes? Who ends up making the covenant with them? Who solves the problems that was created? There\u2019s more than one answer here.

  3. Oath and wrath<\/em>: According to the words of the chieftains (v. 19), it is impossible to break the \u00a0covenant with the Gibeonites, because it was made under oath. Breaking a solemn oath is liable to bring down God\u2019s wrath upon them. Spoiler: In another 88 chapters, and a few generations (II Sam ch 21), somebody will break the oath. And there will be wrath. But in the meantime, peace reigns between Israel and Gibeon.

  4. The cities of the Gibeonites<\/em>: Gibeon, Chephirah, Beeroth, and Kiriath-jearim (v. 17) are situated north-west of Jerusalem. The pact with the Gibeonites thus creates an cooperative enclave between the south of the country and the north. How does this affect the story?
