Their failure to observe this prohibition led to a most striking consequence: The very next military foray, at the city of Ai, projected to be a simple mission (7:3), failed, with the attendant deaths of 36 of the participating soldiers, because someone had sinned, took the spoils, and then tried to cover it up.

A lottery identified the guilty party as member of the tribe of Judah named Achan (18), who confessed to his crime. Apparently acting alone, he plundered gold, silver, and a Babylonian robe in the heat of the battle for Jericho, stashing these treasures in his tent. However, his personal sin brought tragic consequences for his whole nation. The Israelites were subsequently routed in the battle of Ai, losing 36 soldiers and their sense of invincibility.

The example of Achan showed later generations the great moral danger of plundering during wartime, exploiting political violence for personal gain. Tzippori then instructed the soldiers to place any plunder they seized on the ground in front of him, or else risk a military tribunal. An astonishing amount of plundered property gathered before Tzippori.

Achan has also been wielded symbolically to condemn wars instigated for national enrichment. In a 1656 political scandal explored by historian Blair Worden, the ruler of the English Commonwealth, “Lord Protector” Oliver Cromwell was publicly compared to Achan. Following an embarrassing military defeat at the hands of the Spanish military on the island of Hispaniola (today Haiti and the Dominican Republic), English Puritans including Cromwell and his detractors cast about to identify the sin for which England was punished. Cromwell critic Sir Henry Vane invoked the Achan story and charged that the defeat—their modern-day Ai—arose from the “self-interest and private gain” that drove Cromwell to seize power in the aftermath of the English Civil Wars. Bush pursued conflict with Saddam Hussein to benefit financially from Iraqi oil, an Achan charge was made on the floor of the U.S. House of Representatives. On the morning of July 9, 2003, the elected House chaplain, a Catholic priest named Daniel P. Coughlin, delivered a prayer invoking the lessons of “the conquest of Jericho and the sin of Achan,” and expressing hope that, “we, as individual citizens or in any corporate way, never excuse ourselves from honesty and integrity” in the ongoing war. There is no such thing as living a Jewish life that is indifferent to the larger community or aloof from the trials and triumphs of the nation.

A Jew first of all lives his life as an individual before God. At the same time, however, the Jew must live his life conscious of the larger community of which he is part. Not only is Achan stoned to death, but his sin is said to have caused the catastrophic failure of the Israelites to conquer the city of Ai (Joshua 7:1-12, 25).

This sin of one individual Israelite, that resulted in the collective punishment of all the people, seems to have provided the biblical basis for the principle that “All Israel are Responsible for Each Other” (kol yisrael ‘areyvim zeh ba-zeh - see Talmud Bavli Shevu’ot 39a).

According to another Talmudic tradition (Sanhedrin 43b-44a), Achan was already a hardened criminal prior to the conquest of Jericho. He is said to have surreptitiously taken for himself consecrated spoils already several times in the days of Moses. Moreover, he violated the Sabbath, had prohibited sexual relations with a betrothed woman and surgically effaced the sign of his circumcision (epispasm), all of which are capital crimes according to the halakhah. Worst of all, Achan is said to have taken an idol from the spoils of Jericho for his own idolatrous use!

When God informed Joshua that “Israel has sinned” (Joshua 7:11), he asked Him: Master of the Universe! Who is it who has sinned? God replied to Joshua: Am I an informer?! To find out the identity of the sinner, go and cast lots. To narrow the possibilities, Joshua first consulted the breastplate of the High Priest, which normally had twelve shining jewels representing the twelve tribes of Israel. But because the sinner was from the tribe of Judah, that jewel had now become dim.

When Joshua then cast lots among those from Judah, the lot fell on Achan (See Pirqe de-Rabbi Eliezer, Chapter 38). Subsequently, Achan was executed in accordance with the Rabbinic rules for capital punishment (see Mishnah Sanhedrin 6:2). When Achan was nearing the place of stoning, Joshua said to him: “My son, pay honor to the Lord, the God of Israel, and make confession to Him. Tell me what you have done; do not hold anything back from me.” Achan answered Joshua, “It is true, I have sinned against the Lord, the God of Israel. This is what I did: I saw among the spoil a fine Shinar mantle, two hundred shekels of silver, and a wedge of gold weighing fifty shekels, and I coveted them and took them. They are buried in the ground in my tent, with the silver under it” (Joshua 7:19-21).

Significantly, Achan’s confession made atonement for his sins. From this we learn that everyone who makes confession before death is rewarded with a place in the world to come. Achan scoffs at the idea of casting lots, but Joshua pleads, for God’s sake, not to spread slander about the lots, as the Land of Israel will one day be divided by lots. At first Achan does not comply. In fact, Achan’s tribe of Judah stands behind him and begins a civil war. This was too much for Achan. He reasoned ‘anyone who saves a life as if he saves the whole world. I have been the cause of this killing, I have sinned and have caused others to sin. It is better that I admit what I have done before God and Joshua, so that no further harm come upon me’.
