Moses begins the introduction to his song and blessings: \u201cI am now one hundred and twenty years old, I can no longer be active.\u201d The Hebrew \u201c<\/span><i><span style=\"font-weight: 400;\">latzet v\u2019lavo<\/span><\/i><span style=\"font-weight: 400;\">\u201d literally means \u201cgo out and come [in].\u201d Ostensibly, Moses is saying that he is 120 years old and cannot move around anymore, which makes sense for him to say right before he dies.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rashi does not like the literal translation. How could Moses be frail if in a few chapters the Torah says \u201cHis eye was not dim nor his natural force abated\u201d (34:7)? He gives two answers. The first is that Moses was not permitted to move on. God had given that role to Joshua. This first answer matches the second part of the verse: \u201cGod said to me, \u2018You shall not go across yonder Jordan.\u2019\u201d This must be the explanation for the first part. Moses cannot move beyond this point because God decreed it.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rashi\u2019s second answer is that Moses could no longer provide guidance in the Torah. The use of go out and come in evokes the blessings and curses of a few chapters ago. \u201cBlessed shall you be in your comings and blessed shall you be in your goings.\/ Cursed shall you be in your comings and cursed shall you be in your goings\u201d (28:8 and 19). Perhaps Moses uses this phrase specifically to let the people know not just that he is no longer able to move forward, but that he is beyond the physical implications of blessings and curses. Additionally, while he may no longer be able, the people are now given the opportunity to move forward. The path before them is the same that Moses laid out three chapters earlier. If they follow God they will be blessed like Moses had been blessed, but if they fail to follow God, then their comings and goings will not be as pleasant as those of But the commandment to \u201cwrite this song for yourselves\u201d ties right back to the verses in Chapter 30 that tell us that the internalization of Torah comes from the heart, not the head, and that is what will ensure our continuity. With this final commandment we\u2019re reminded that the Torah must be realized anew and brought to life by each generation. It\u2019s not sufficient to pass it down cerebrally \u2013 it must speak to the heart so that not just each generation but each individual, can write their own song.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Not just through words on a page but through song is how, until today, we express our national experience. We don\u2019t merely read the Torah, we chant it; we don\u2019t say prayers, we sing them, and even in studying the Talmud, we don\u2019t simply read aloud, but we inject a very identifiable sing-song quality. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The 20<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> century lyricist E.Y. Hamburg said \u201cWords make you think a thought. Music makes you feel a feeling. Gather the people\u2014men, women, children, and the strangers in your communities\u2014that they may hear and so learn to revere the LORD your God and to observe faithfully every word of this Teaching. Their children, too, who have not had the experience, shall hear and learn to revere the LORD your God as long as they live in the land that you are about to cross the Jordan to possess (Deut. 31:10-14)<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This is the point where we learn what Moses has really been doing all along.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">We know he has been teaching the people Torah\u2014that much is obvious. We know he has been transmitting his final words, and along with them, the word of God.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But the truth is, Moses is doing something more than that. Moses is modeling what the Jewish people will have to do for as long as we want Torah to exist among us. Moses is teaching the people how to teach Torah: to themselves, to each other, and to their children who never saw or experienced what they did. Moses is teaching a generation that never saw Sinai what it means to teach Torah to your children so that they feel the fire and the voices in their bones. He is teaching them what it means to feel as if your ancestors sins are your sins, as if their encounters with God are yours. And most important of all, Moses is teaching them how to transmit that to their children as well. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Moses will never meet the grandchildren of the generation he is teaching at this moment. Very old. At the age of 120, in verse 2 of Chapter 31, Moses acknowledges his age, and the limitations associated with getting on in years. \u201cI am a hundred and twenty years old today; I can no longer go out and come in.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Talmud Sotah 13b insists that this statement is not referring to Moses\u2019 physical frailty. It cannot mean that Moses\u2019 physical strength is waning in his old age because in another few chapters, when Moses passes away, the text tells us that he was full of strength and vigor right until the end (\u201chis eye was not dim, nor his natural force abated\u201d - Deut\u05e5 34:7) . If that is so, then the verse here in Chapter 31, cannot be understood literally, that his old age prevented him from continuing his leadership. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">So what is Moses saying, when he describes his inability to \u201cgo out and come in\u201d?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Though Moses was at his full physical strength, the Talmud explains, he could no longer \u201cgo out and come in\u201d with words of Torah - \u201cThe gates of wisdom were closed off to him.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Moses is recognizing, at the end of his life, that he has shared all the wisdom that he can offer. His own leadership has run its course. It is time for him to step down and to pass the torch to the next generation.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It is hard for most of us to acknowledge when it is time to step back and allow someone else to take the helm, when a new perspective is needed. In so many contexts - career, volunteer work, family life - people often hold onto positions of leadership for too long, and miss the opportunity to effectively pass the torch. A congregant of mine, in her seventies, hosted her family\u2019s very large seders for many decades.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">She loved doing it, and she still had the strength and the ability to continue. However, she recognized that it was time to encourage her children - now grown, with families of their own - to take on the responsibility of hosting the seders. She wanted to make this transition while she would still be able to offer advice and help, as the next generation took on this important family tradition.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Moses had spent years mentoring Joshua, ensuring that the next generation of leadership would be strong. He understood that it was time for him to step back when his leadership had run its course, when his wisdom would no longer \u201cgo out and come in\u201d, would no longer be effectively heard and heeded. Moses serves as a model for graciously offering mentoring and guidance to those who will come next, and then stepping back and showing trust that, even without you, the enterprise is in good The Jewish people\u2019s two most fundamental \u201corienting events\u201d (the term is Yitz Greenberg\u2019s) are the Exodus<\/span> <span style=\"font-weight: 400;\">from Egypt and the revelation at Mount Sinai. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Moses mandated a periodic public reading of these events: \u201cEvery seventh year... Gather (<\/span><i><span style=\"font-weight: 400;\">hak\u2019hel<\/span><\/i><span style=\"font-weight: 400;\">) the people\u2014men, women, children, and the strangers in your communities\u2014that they may hear and so learn to revere the Lord your God and to observe faithfully every word of this Teaching\u201d (Deuteronomy 31:10-12). This mitzvah is supposed to represent a recurrent reenactment of the revelation and sense of unity experienced at Sinai.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Why is the reenactment held during the <\/span><i><span style=\"font-weight: 400;\">shemitah <\/span><\/i><span style=\"font-weight: 400;\">year, the year of \u201crelease\u201d? Every seventh year, the Israelites are commanded to cancel debts and (crucially) to release all debt slaves (15:1-3, 12-15). Every seven years, therefore, some Israelites will have just been liberated from slavery, enabling the people as a whole to remember the central event which precedes Sinai\u2014God\u2019s redemption of Israel from bondage. If the public reading reenacts Sinai, its timing aims to re-create the totality of Israel\u2019s foundational story\u2014the freeing of the slaves leading to the revelation at Mount Sinai. The memory of revelation thus remains permanently entwined with the experience of redemption.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Further, in presenting the laws of <\/span><i><span style=\"font-weight: 400;\">shemittah<\/span><\/i><span style=\"font-weight: 400;\">, Deuteronomy emphasizes that people who are poor are \u201cyour brothers\u201d (15:2, 3, 7, 9, 11, 12). Differences in economic status, which ordinarily drive such deep wedges between people, are here overridden by a deeper truth. \u201cAmong members of this community, economic realities are not definitional; rather, what is definitional is a common memory of the Exodus; a common blessing in the land; and a common allegiance to the God of Exodus and land\u201d (Walter Brueggemann, <\/span><i><span style=\"font-weight: 400;\">Deuteronomy <\/span><\/i><span style=\"font-weight: 400;\">(2001). In a year when economic competition is put on hold, when generosity and a commitment to sharing are actively cultivated, real peace between people becomes more possible (Keli Yakar to Deuteronomy 31:12). And this peace enables an authentic return to Sinai.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Once every seven years, the Torah beckons us back to Sinai. In the process, it reminds us of\u2014 it actively <\/span><i><span style=\"font-weight: 400;\">enacts <\/span><\/i><span style=\"font-weight: 400;\">for us\u2014the essence of communal living. Despite the illusions fostered by social and economic inequality, we are all brothers and sisters in the covenant. The Mishnah in Masechet Sota 7:8 elaborates on a seemingly minor detail, how the Torah scroll is removed from the Ark: <\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">The officer of the synagogue takes the Torah scroll and gives it to the head of the synagogue, and the head of the synagogue gives it to the chief, and the chief, gives it to the High Priest, and the High Priest gives it to the King. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">What is the purpose of having so many people passing the Torah before it is read? One way to answer this question would be to find other places where the Mishnah mandates passing objects between people, and trying to understand what the significance of the action is in those settings. Perhaps, some of that significance could be part of what is intended here as well. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">One of the other places in the Mishnah where we see something being passed along a row of people is in Pesachim 5:5, where the blood of the Pesach offering is passed along a row of priests to from where it is slaughtered to where it is thrown on the altar. This is done because in the chaos of all of the offerings on Pesach, if the priests were to carry the bowls of blood normally, they would run the risk of running into each other and spilling. Rather than take that risk, they pass the bowls down lines to protect the precious blood inside. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Another place where we see a similar image is in Eruvin 10:1-2, where one of the solutions to finding Tefillin laying on the ground outside the Shabbat boundary is to line people up to pass them until the reach back inside the boundary. Rather than leaving them until after Shabbat, or violating Shabbat to carry them in, we gather enough people to pass them to where they need to be. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In both these cases, lining up to pass something is done for precious objects that need to be protected, even at the cost of great inconvenience and investment of manpower. \u00a0Perhaps here too, what is being communicated is that Torah is one of those things that is extremely precious and worth the kind of protection we see in the earlier two cases. God announces to him: <\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">The time is drawing near for you to die. Call Joshua and present yourselves in the Tent of Meeting, that I may instruct him. Moses and Joshua went and presented themselves in the Tent of Meeting. The Lord appeared in the Tent, in a pillar of cloud, the pillar of cloud having come to rest at the entrance of the tent (Deuteronomy 31:14-15). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Midrash (Deuteronomy Rabbah 9:9) elaborates on this fatal scene in a dramatic and poignant way: When Moses learned that he was about to die he wrote thirteen Torah scrolls; twelve for the twelve tribes of Israel and one official copy to be placed in the Ark of the Covenant, to prevent anyone trying to forge an unauthorized version of God\u2019s word. By occupying himself with repeatedly copying out the Torah, Moses hoped to postpone his own death for as long as possible. But, when God finally told Moses to call Joshua in order to transfer authority to him, Moses suggested to God that Joshua might take over Moses\u2019 role of leader of Israel, but Moses himself would continue to live in retirement. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">God responded by telling Moses to treat Joshua as Joshua had always treated him. Moses went to Joshua, who became frightened when he saw Moses coming. Moses said to Joshua: Do not be afraid, for you are now my teacher! Come with me. When they set out, Moses walked on the left side of Joshua, the way a disciple walks with his Rabbi. When they entered the Tent of Meeting, the pillar of cloud separated them. When it departed, Moses asked Joshua what the Divine Presence of God had imparted to him. Joshua replied: When God would speak only to you, would you tell me what He said? At this cutting remark, Moses cried out bitterly: Better to experience death a hundred times than to experience envy even once! As Solomon said: \u201cLove is strong as death; jealousy is cruel as the grave\u201d (Song of Songs 8:6). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This refers to Moses\u2019 love for Joshua, but also to his jealousy, when Joshua took over Moses\u2019 leadership of Israel. When Moses finally resigned himself to die, God found a way to comfort him. And not for his own musing, but in order to talk to the People \u201call these things\u201d (31:1). How come no one said, \u2018oh, Moses is getting old, our journey is nearing its end, we should catch as much Torah time with him\u2019\u2026 Instead, the humblest person we know of gets up and goes, possibly teaching us too that we need to learn to walk\u2026<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">At 120, he also writes the Torah, coincidentally (or not) in the same chapter he \u201cwalks\u201d, perhaps suggesting a connection between walking, <\/span><em><span style=\"font-weight: 400;\">lalechet<\/span><\/em><i><span style=\"font-weight: 400;\">, <\/span><\/i><span style=\"font-weight: 400;\">and <\/span><em><span style=\"font-weight: 400;\">halacha<\/span><\/em><span style=\"font-weight: 400;\">, Jewish Law. He wrote 13 scrolls: one for each tribe and one to be placed in the holy ark, but the question remains: Did he himself write the whole thing?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Torah says so (31:9), but then, could Moses write about his own death? Some say that as God\u2019s secretary he would write whatever the Boss dictated! While others say that writing about his own death would have been too much to ask, and Joshua wrote that. Ah, but once we say that any part of the Torah was written by someone else, then what about other seemingly out-of-place verses?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">When my kids were young we used to read <\/span><em><span style=\"font-weight: 400;\">The Always Prayer Shawl<\/span><\/em><span style=\"font-weight: 400;\">. The book follows a prayer shawl that has been passed down through the generations. But alas, it needs repairs: the fringes unravel, the writing fades, the cloth tears. Each generation in its turn fixes something, and slowly, everything about it is new, except that it\u2019s the \u201calways prayer shawl\u201d, the same exact one\u2026.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">I think of this story often: one of our principles is that God gave this very Torah to Moses, but the Torah was also given to us, and it didn\u2019t stay in the heaven (Bava Metzia 59b). Furthermore, if Moses got the whole Torah already at Sinai, why was he worried during Korach\u2019s rebellion? Why plead to go into the Land? And if he didn\u2019t, what would be the ramifications of that??<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">For me it's like the Always prayer shawl: too many changes might make the shawl a table cloth or a dress. The Torah we have is, of course, the Torah of Moses, exactly, and yet, at the same time, it is being written again and again by us anew, as it being transmitted from one generation to the It was read, or more precisely, proclaimed. The book of Deuteronomy refers to a seven-yearly convocation of the entire people, men, women and children, to hear the Torah publicly recited by the king. This was a moment of national education, \u201cso that they can listen and learn to fear the Lord your God and follow carefully all the words of this law\u201d (Deuteronomy 31:12). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But it was also a political-religious event. It renewed the covenant with Israel as a people under the constitution of Torah. The regular reading of the Torah in the synagogue, with its echoes of this national ceremony, was thus a reminder and ratification of the terms on which Jews came together to form communities. As Daniel Elazar notes, individual congregations reproduced in miniature the classic terms of Jewish nationhood. \u201cIn effect, every local Jewish community, as a congregation, was considered to be a kind of partnership based upon a common contractual obligation within the framework of the overall Jewish constitution, namely the Torah.\u201d \u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: Now he seems to be at peace with God\u2019s judgment and is forthcoming in regard to both his ebbing strength and his disappointment at being unable to lead the Israelites into the Promised Land. His words to the people are full of encouragement, as he promises them that even though he will not be with them, God will help them conquer the land: \u201cThen Moses called Joshua and said to him in the sight of all Israel \u2018be strong and resolute for it is you who shall go with this people into the land that the Lord swore to their fathers to give them and it is you who shall apportion it to them\u2019\u201d (Deut. 31:7).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Joshua had been at Moses\u2019 side for many years: \u201cThe Lord would speak to Moses face to face as one man speaks to another\u2026his attendant Joshua, son of Nun, a youth, would not stir out of the tent\u201d (Exod. 33:11). Moses had chosen Joshua to lead the battle against Amalek (Exod. 17:9). Further, he took Joshua with him up to the mountain of God when he ascended to receive the Torah (Exod. 24:13), and it was Joshua \u00a0who heard the noise of the people celebrating around the Golden Calf (Exod. 32:17). Joshua was also the man who challenged the majority report of the spies (Num. 14). God told Moses: \u201cSingle out Joshua, son of Nun, an inspired man, and lay your hand upon him\u201d (Num. 27:18), which Moses did in front of Elazar the priest and before the whole community. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Why then did Moses choose to perform another official ceremony, as described here, on the last day of his life?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Avner Moriah visualizes this seemingly redundant ceremony<\/span><i><span style=\"font-weight: 400;\">. <\/span><\/i><span style=\"font-weight: 400;\">The picture shows an aged Moses leaning on his staff speaking to Joshua, who is standing upright with his arms folded, clearly very attentive and respectful toward his master. There is no \u201claying on of the hands\u201d as in the earlier ceremony. Behind the two men we see a range of brown hills, with a large gap between two of the peaks. The long white extended hand of God is stretched out over the gap, and the Israelites are using it as a bridge to the Promised Land, as it says: \u201cThe Lord your God Himself will cross over before you; and He Himself will wipe out those nations from your path and you shall dispossess them. Joshua is the one who shall cross before you, as the Lord has spoken\u201d (Deut. 31:3).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Here, the Israelites are witnessing the close and caring relationship between Moses and Joshua and projecting a sense of unity in their acceptance of Joshua as their new leader. This was an important moment, as many of the earlier episodes in which Joshua was involved occurred during times of disunity and strife. What is the significance of these two terms, particularly at this time of year, the ten days of repentance, when we are reviewing our deeds of the past to try to decide what should stay and what should go?\u00a0<\/p>\r\n<p>How can it be that something as impermanent as\u00a0a \u201csong\u201d as the Torah is called can also be a \"witness\"?\u00a0These two terms encapsulate two sides of the text: on the one hand something enduring and permanent, as constant as a witness, and on the other something that can be modulated, sung in different keys, adapted to the pitch and timbre of the singer, fluid rather than fixed.\u00a0<\/p>\r\n<p>A description of the voice of singer Jessye Norman, who passed away this week, can serve to explain the value of song. <a href=\"https:\/\/www.nytimes.com\/2019\/10\/01\/arts\/music\/jessye-norman-dead.html\">Anthony Tomassini<\/a> writes that her voice was always, \u201cenveloping you, coming at you from all corners of the opera house.\u00a0 Her voice penetrated; it permeated.\u201d If we think of Torah as a song that we all need to give voice to, it is a tremendous task to have an instrument that contains such power as to be able to permeate its listeners. But the possibility that it can attain that power makes it necessary to maintain the instrument properly.<\/p>\r\n<p>A witness\u2019 testimony needs to be seen and interpreted over time.\u00a0A recent novel by Siri Hustvedt, <em>Memories of the Future<\/em>, illustrates this clearly with its premise that the writer has found a journal she kept her first year out of college among the things of her elderly mother. The physical writing in the journal proves that the writer cared about certain things and noted others, yet many of its entries were events she did not recall. Her subsequent reading of her journal and grappling with what events meant to her, give it new meaning forty years after it was written.\u00a0 \u00a0<\/p>\r\n<p>The Talmud in Sanhedrin 21b teaches that \u201ceven if his ancestors left a person a Torah, it is a mitzvah to write one of his own, as it is written, \u201cand you should write for yourselves this song\u201d (Deut. 31:19). The very last mitzvah in the Torah, too, is to write your own scroll, according to the Sefer Hachinuch. The tension between the two, having something your ancestors had and yet needing to make it your own, is like the tension between the fixity of the text as witness and the fluidity of poetry as song.\u00a0In order for us to feel the power and significance of the Torah, we need to give it space to be both a song that can permeate its hearers as well as a witness who reminds them of all past deeds.\u00a0<\/p>\r\n<p>May we all be inscribed in this new year for a year of Moses tells the people, \u201cI am now a hundred and twenty years old, and I can no longer go forth\u201d (Deut. 31:2). He will not be leading them across the Jordan into the Promised Land. He then summons his successor Joshua and, in the presence of the people, gives him words of encouragement. He instructs the people to gather every seven years to hear a public reading of the Torah.<\/p>\r\n<p>God appears to Moses and Joshua, warning them that the Israelites may eventually stray from the covenant. He instructs them to write down the Torah and teach it to the people, as permanent testimony of the covenant itself. He then encourages Joshua, assuring him that He will be with him as he leads the people.<\/p>\r\n<p><a According to verse 2, he really can no longer lead the people. But three chapters hence (Deut. 34), his health and well-being is surprisingly better.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Be strong and of good courage (<\/span><span style=\"font-weight: 400;\">chazak ve\u2019ematz<\/span><\/em><span style=\"font-weight: 400;\"><em>)<\/em>. This is said twice to Joshua and once to the people. Joshua will also hear this message of empowerment again in Joshua 1. But then we have to wait another 698 chapters until another leader will receive similar encouragement (I Chron. 22).<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Poetry and Torah<\/em>. There is a certain similarity between the Torah, written as a form of testimony, and poetry. But there are also differences. It\u2019s worth exploring.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>God\u2019s hidden face<\/em>. The idea and phrase is from here, in the picturesque description of verse 18: \u201cI will keep My countenance hidden.\u201d<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>The end of days?<\/em>\u00a0Verse 29 - When will that be exactly?
