The murder of Gedaliah has been previously narrated in II Kings 25:22-26. Moreover, Jeremiah Chapters 39-40 has expanded on the relationship between Jeremiah and Gedaliah and has detailed the events leading up to Gedaliah\u2019s murder. Johanan son of Kareah and his fellow officers warn Gedaliah that Ishmael son of Nethaniah is plotting his assassination. Regrettably, Gedaliah replies to Johanan: \u201c\u2026What you are saying about Ishmael is not true!\u201d (40:14-16). Gedaliah\u2019s unwarranted trust in Ishmael, \u201cwho was of royal descent and one of the king\u2019s commanders\u201d (41:1) leads to Gedaliah\u2019s demise: \u201cThen Ishmael son of Nethaniah and the ten men who were with him arose and struck down Gedaliah son of Ahikam son of Shaphan with the sword and killed him, because the king of Babylon had put him in charge of the land\u201d (verses 2-3). The bodies of those murdered were then thrown into a cistern (verses 7 and 9).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">According to Talmud Bavli Niddah 61a, in early Rabbinic times (1<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> century CE) the sages discovered a large cistern full of bones, which they identified as the very cistern that Ishmael had filled with the bodies of those he had murdered. Surprisingly, this text goes on to hold Gedaliah at least indirectly responsible for this whole incident. This is suggested by a literal reading of Jeremiah 41:9, which speaks of the bodies of those slain \u201cby the hand of Gedaliah\u201d \u2013 <\/span><i><span style=\"font-weight: 400;\">be-yad Gedaliah <\/span><\/i><span style=\"font-weight: 400;\">(but more contextually translated \u201cin the affair of Gedaliah\u201d). This leads to the assertion that because Gedaliah rejected the warning of his imminent assassination, Scripture regards him as if he himself had killed those who died with him!<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Despite this midrashic suggestion implicating Gedaliah in his own death and in the death of his companions, the sages determined that \u201cthe fast of the seventh month\u201d (Zechariah 8:19) commemorates the murder of Gedaliah, which occurred \u201cin the seventh month\u201d (see II Kings 25:25 and Jeremiah 41:1). According to Talmud Bavli Rosh Ha-Shanah 18b, fasting to mourn the murder of Gedaliah teaches that the death of the righteous is as tragic as the \u201cburning of the House of our God\u201d (i.e. the Destruction of the Temple). This fast is celebrated on the 3<\/span><span style=\"font-weight: 400;\">rd<\/span><span style=\"font-weight: 400;\"> of the month of Tishri, since fasting would be inappropriate on the two-day celebration of Rosh HaShanah at the beginning of Tishri. The \u201cFast of Gedaliah\u201d is classified as a \u201cminor fast\u201d, on which it is customary to not eat from dawn to dusk.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It should be noted that Tzom Gedaliah is one of four fasts that Zechariah prophecies: \u201cshall become occasions for joy and gladness, happy festivals for the House of Judah. This famous phrase, or at least the first half, has often been used as a rallying cry for \u201cJewish values,\u201d for the pursuit of justice. But what does it mean? Why is the phrase repeated twice?\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In context, the verse seems to only be relevant to judges and courts. Rashi explains that the phrase simply means that one should seek out proper judges and that setting up a proper legal system is enough to keep the people in the land. Sforno adds that the commandment involves proper vetting of judges so that they are known for fairness before their selection. The Talmud in Sanhedrin 32b explains that this guiding principle must be present in every aspect of a case, not just the final decision. Compromise must also be achieved with justice in mind. Ibn Ezra also focuses on the repeated term to explain that justice must envelope the final determination even if the end result would be financial loss for the arbiter.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Ramban separates the repeated words to refer to two types of justice. The first part is natural law, the actual justice of this world. The second justice is the justice of the world to come. This second justice is the reward for pursuing a just life in this world. Rabbi Joseph Soloveitchik expands on Ramban\u2019s opinion. Justice in this world is imperfect. For justice to happen, truth and peace may often be in conflict. A just compromise in court to maintain peace invariably includes some untruth as two litigants must compromise an aspect of their truth.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">This meaning is derived from a midrash describing a fight between the angels representing righteousness and justice on one side and truth and peace on the other. Truth and peace did not want humans to be created as they knew humans could never achieve peace and truth in their lives. God removed truth and only kept peace as righteousness and justice could live with peace in this world. In the world to come, however, truth would be restored to allow for full harmony between truth, peace, justice and righteousness. This is the second justice in the verse.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">All of these interpretations, however, are still grounded in the context of the verse, judges and the law. Rabbi Samson Raphael Hirsch extends this concept to all aspects of public and private life. The guiding principle must always be striving for justice. Perhaps Hirsch is motivated to expand the meaning beyond the basic context because the verse can live independently in the structure of this section. Following on the heels of the verses regarding the three pilgrimage festivals, this verse is a directive to the people to not hold up the judicial process until they make their pilgrimage, but to set the wheels of justice in motion without delay.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The injunction to set up judiciaries is coupled with the order to ensure the appointed judges are of righteous character, and the caution in verse 19 that \u201cyou shall not pervert judgement.\u201d Why is that cautionary note directed toward the Israelites? Surely it\u2019s the judges themselves who should be held accountable for any perversions of justice.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Or HaChaim takes an extraordinary view, stating that \u201cthose who fail to appoint the proper judiciary contribute to unfair judgements\u201d and God holds accountable both the appointers and appointee for any perversions of justice. It\u2019s not a far leap to substitute \u201celectors and elected\u201d for \u201cappointers and appointees\u201d which should stop us in our tracks when we consider current political climates and the modern electoral process. Be careful about who you appoint\/elect, not just because of potential outcomes but also because you are at least in part responsible for their actions.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">And finally comes the peculiar final verse of Chapter 16, admonishing the Israelites to not plant idolatrous trees. What does an idolatrous tree have to do with corrupt judges? Rav Nachman, in his work Otzar haChaim, teaches that a corrupt judge is one who is easily influenced by public opinion, just as a tree bends and sways to the whim of the wind. And, according to the teachings of Rabbi Chaim Soloveitchik, though it may look much like all others from the outside, the corrupt judge, like the idolatrous tree, is rotten in its core.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">We won\u2019t see the perversions to come, or the rottenness, from the exterior persona or beautiful leaves, but it will eventually become evident. You shall not misdirect judgement. You shall show no partiality. You shall not take bribes, for bribery blinds the eyes of the wise and falsifies the words of the righteous. You shall show no partiality\u2019\u201d \u2013 this is a warning to the <\/span><i><span style=\"font-weight: 400;\">Nasi<\/span><\/i><span style=\"font-weight: 400;\">.\u201d Now, in Rabbinic times, <\/span><i><span style=\"font-weight: 400;\">Nasi<\/span><\/i><span style=\"font-weight: 400;\"> was the title of the \u201cChief Justice\u201d of the Sanhedrin. Today, <\/span><i><span style=\"font-weight: 400;\">Nasi<\/span><\/i><span style=\"font-weight: 400;\"> is the title of the President of the State of Israel, who is formally charged with delegating the presumptive Prime Minister to attempt to form a coalition government. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">\u201cNo <\/span><i><span style=\"font-weight: 400;\">Nasi<\/span><\/i><span style=\"font-weight: 400;\"> should elevate the undeserving to high office, in preference to those who are worthy of being placed in positions of authority. Another interpretation: \u2018You shall not misdirect judgement\u2019 in monetary matters. And \u2018You shall show no partiality\u2019 in the respect that should be shown to all litigants, for example, by letting the rich sit, while the poor remain standing. \u2018You shall not misdirect judgement\u2019 is also a warning to the Rabbinic Sage. He must not sit in judgement with another not qualified to serve as judge. For if he does so, it is as if he has planted an <\/span><i><span style=\"font-weight: 400;\">Asherah <\/span><\/i><span style=\"font-weight: 400;\">(a tree worshipped as a foreign deity), as indicated by what follows immediately in the biblical text: \u2018You shall not plant for yourself an <\/span><i><span style=\"font-weight: 400;\">Asherah <\/span><\/i><span style=\"font-weight: 400;\">of any kind of tree beside the altar of the Lord your God\u2019\u201d (verse 21). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">\u201cAnother interpretation of \u2018You shall not misdirect judgement\u2019 \u2013 Judges should conduct themselves as if the Shekhinah were sitting in judgement with them, as it says: \u2018God judges amongst the judges\u2019 (Psalms 82:1). Moreover, judges are told: \u2018Consider what you are doing, for you judge not only man but also God\u2019 (2 Chronicles 19:6). Rabbi Hama bar Hanina exclaimed: \u2018If this were not written in Scripture, it would not be possible to say that mere flesh and blood human beings judge their Creator! The beauty of justice is that it belongs to a world of order constructed out of universal rules through which each of us stands equally before the law. <\/span><\/p>\r\n<p><em><span style=\"font-weight: 400;\">Chesed<\/span><\/em><span style=\"font-weight: 400;\">, by contrast, is intrinsically personal. We cannot care for the sick, bring comfort to the distressed or welcome a visitor impersonally. If we do so, it merely shows that we have not understood what these activities are. Justice demands disengagement (Adam Smith spoke of adopting the standpoint of an \u2018impartial spectator\u2019). <\/span><span style=\"font-weight: 400;\"><em>Chesed<\/em> <\/span><span style=\"font-weight: 400;\">is an act of engagement. Justice is best administered without emotion. <\/span><em><span style=\"font-weight: 400;\">Chesed<\/span><\/em><span style=\"font-weight: 400;\"> exists only in virtue of emotion, empathy and sympathy, feeling-with and feeling-for. We act with kindness because we know what it feels like to be in need of kindness. In the Pesach section, we are enjoined to eat matzot for seven days and to eschew leavened bread, so that we may \u201cremember the day of [our] departure from the land of Egypt as long as [we] live.\u201d This makes sense. The national memory of running out the door, not having enough time to let our bread rise, having to eat \u2018poor man\u2019s bread,\u2019 will serve us well as a constant, life-long reminder that we are forever indebted to God for having saved us from the hellhole that was Egypt.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">A reminder found in the Shavuot section is more curious. \u201cBear in mind that you were slaves in Egypt, and take care to obey these laws.\u201d What in the world does Egyptian slavery have to do with <\/span><em><span style=\"font-weight: 400;\">Chag HaAsif<\/span><\/em><i><span style=\"font-weight: 400;\">,<\/span><\/i><span style=\"font-weight: 400;\"> the festival that celebrates the first big yield in the annual Land of Israel harvest cycle? <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">It has everything to do with it. God and Moses are fearful \u2013 and rightfully so \u2013 that once they\u2019ve entered the Promised Land, the Israelites will become farmers, raise their crops, reap their produce, and begin to believe that their own efforts have allowed for a bountiful harvest. I mean, why not believe that? Farmers work extremely hard every day of their lives.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">When God and Moses tell the Israelites to observe Shavuot, offer free-will produce offerings commensurate with how much they\u2019ve been blessed in their fields, and share the joy with everyone in their household, including their servants, the stranger, the fatherless, and the widow in their midst alongside their own family, they must also remember that they used to be slaves. They used to be slaves in Egypt, where they weren\u2019t free to make choices about their planting. Where they couldn\u2019t own any land. They used to be slaves in Egypt, and God took them out and brought them to their own land, where He is the only Master. They used to be slaves in Egypt, and now they are free men, who owe their lives and their livelihood to God. They must remember, so they can acknowledge God in all that they have. And so they can share the bounty of the land, which is truly God\u2019s and not their own.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">When you\u2019ve been a slave, you know what it is to be a stranger, fatherless, and a widow all at the same time. When you\u2019ve been a slave, you can never forget the kindness of another. When you\u2019ve been a slave, and can remember being a slave, you can appreciate everything you have and share it with everyone in your midst.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">So God and Moses tell the Israelites: You MUST remember. What did he reveal here that was new?","post_main_content_content":"<p><span style=\"font-weight: 400;\">The three pilgrim festivals discussed in this chapter\u2013 Passover, Shavuot, and Sukkot, each associated with a particular season of the year \u2013 were referred to earlier in Leviticus 23 and Numbers 28\u201329. Here in connection with Passover we read: \u201cObserve the month of Abib (spring) and offer a Passover sacrifice to the Lord your God\u2026\u201d (16:1). Shavuot is the festival that celebrates the harvesting of the first wheat and fruit crops: \u201cYou shall count off seven weeks; start to count the seven weeks when the sickle is first put to the standing grain\u201d (16:9). Sukkoth, which falls in the autumn, celebrates the last harvest of the year: \u201cAfter the ingathering from your threshing floor and your vat, you shall hold the Feast of Booths for seven days\u201d (16:13). Why did Moses relate to these festivals for the third time? What did he reveal here that was new?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Regarding Passover, the reference to \u201cthe month of Abib\u201d in this context is unique to this text. The emphasis here appears to be on the agricultural aspect of the festivals, which demands that they be celebrated at the appropriate times. Every so often - like this year - \u00a0an extra month (Adar II) is added to the Jewish calendar just before Passover to reconcile the lunar and solar cycles so that the pilgrimage festivals can be celebrated in their appointed seasons.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The painting is divided into three registers, one for each of the festivals. The top register, concerning Passover, includes three separate scenes, two of which are set against a green background, an allusion to the spring, the month of Abib. The white pyramids in the upper image recall the Exodus, and we see the Israelites marching upon what seems to be an outstretched long white arm leading them away from Egypt. The lower right-hand image depicts the tenth plague \u2013 the death of the Egyptians\u2019 firstborn \u2013 after which Pharaoh finally agreed to let the Israelites go. The scene to the left shows the crossing of the Sea, \u201cFor it was in the month of Abib at night that the Lord your God freed you from Egypt\u201d (16:1).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The middle register portrays reaping on Shavuot, suggested by the figure of a farmer with a pitchfork piling up the grain he has cut. The bottom register, which shows several women gathering the ripened crop, is a reference to the time of the year\u2019s last harvest, which is celebrated on Sukkot. See Ex. 23:17 and Ex. 24:23.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Celebration.<\/em> The idea of <\/span><em><span style=\"font-weight: 400;\">simcha<\/span><\/em><span style=\"font-weight: 400;\"> (rejoicing,joy) is mentioned three times in the course of the chapter (verses 11, 14 and 15), and it is always about a shared celebration: \u201cYou shall rejoice in your festival, with your son and daughter, your male and female slave, the Levite, the stranger, the fatherless, and the widow in your communities\u201d (verse 14).<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>The cultic center is in one place, the law is everywhere.<\/em> \u201cYou are not permitted to slaughter the passover sacrifice in any of the settlements that the LORD your God is giving you\u201d (verse 5), but \u201cYou shall appoint magistrates and officials for your tribes, in all the settlements that the LORD your God is giving you\u201d (verse 18).<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>What time exactly was the Exodus<\/em>? Answer in verse 6.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Justice as an existential foundation<\/em>. That\u2019s the precondition for national life: \u201cJustice, justice shall you pursue, that you may thrive and occupy the land that the LORD your God is giving you\u201d (verse 20).<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>What does God hate<\/em>?
