The prohibition against taking God's name in vain is one of the Ten Commandments. Vows for sacrifices, property, and even oneself were discussed in Leviticus. Earlier in Numbers, the Torah discussed the laws of the vow of the nazirite. Offering various scenarios in which a man has the ability to nullify the vows of his wife and daughter, this chapter can be a difficult read from a modern standpoint.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">As in all of these previous chapters, this one is filled with arcane halachot. For example: How long does a father have to annul a vow? There is a disagreement in the Talmud, Nedarim 76b. Verse 6 states: \u201cBut if her father restrains her on the day he finds out, none of her vows or self-imposed obligations shall stand.\u201d\u00a0 One opinion is that the father has until the end of the day that he hears the vow to annul it. Another opinion is that the father has one day from when he hears the vow to annul it.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The second opinion seems to contradict the Mishnah that only referenced the \u201cday of\u201d opinion. The Mishnah also provided two examples to demonstrate the extremes of the \u201cday of\u201d opinion. If the daughter makes a vow on Friday evening right after nightfall, then the vow can be annulled until the next nightfall giving a full 24 hour period. However, if she made the vow just before nightfall, then the father only has a few moments to annul the vow before nightfall comes and with it the next day. The first opinion is from verse 6. However, the second opinion comes from verse 15: \u201cIf her husband offers no objection from that day to the next, he has upheld all the vows or obligations she has assumed.\u201d The phrase \u201cday to the next\u201d implies that the father has a 24 hour period that could last from one day to the next. In the end, the halacha is that the father can only nullify the vow the day that he hears it.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">What kind of vows can a husband nullify? At first the Torah states that if a woman makes a vow her husband can nullify it but if\u00a0 \u201cher husband learns of it, yet offers no objection\u2014thus failing to restrain her\u2014all her vows shall stand and all her self-imposed obligations shall stand\u201d (verse 12). This seems to imply that he can nullify all of her vows, like a father to daughter. But later the Torah states: \u201cEvery vow and every sworn obligation of self-denial may be upheld by her husband or annulled by her husband\u201d (verse 14). The Talmud in Nedarim 79b points out that the second verse limits the first verse. There is a prohibition that he's struggling with upholding, and it's not a minor one. It's mentioned numerous times in the Torah, and the rabbis have the harshest words for he who violates it.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Pop quiz: is the rabbi's role:<\/span><\/p>\r\n<ol>\r\n\t<li><span style=\"font-weight: 400;\">a) to chastise him for daring to put his own struggle up against the word of God<\/span><\/li>\r\n\t<li><span style=\"font-weight: 400;\">b) to strengthen and encourage him to overcome his temptations, overcome himself, to see this as a test from God of his commitment,<\/span><\/li>\r\n\t<li><span style=\"font-weight: 400;\">c) to emphathically, sensitively, lovingly tell the man that he hears his struggle...but there's nothing to do,<\/span><\/li>\r\n\t<li><span style=\"font-weight: 400;\">d) to creatively find him a way out?<\/span><\/li>\r\n<\/ol>\r\n<p><span style=\"font-weight: 400;\">In the world of vows introduced in Bamidbar 30, the answer is D.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In Jewish thought, repeated several times throughout Tanach, and emphasized by the rabbis, a promise is a promise. \u00a0Vows are serious business; on the Day of Atonement, it's the very first sin we try to deal with. Our words and commitments are holy, and a prohibition we create for ourselves is binding; breaking your word is considered <\/span><em><span style=\"font-weight: 400;\">hillul<\/span><\/em><span style=\"font-weight: 400;\">- a profaning of the sacred.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">And so, the mishna in Hagiga seems to relate harshly to the idea of permitting vows, saying that it is an endeavor which \"flits in the air, and has nothing to rely on.\" But Shmuel, one of the most important rabbis of the Gemara, disagrees. The idea that 'he shall not profane his word' he reads with creative minimalism- <\/span><em><span style=\"font-weight: 400;\">he<\/span><\/em><span style=\"font-weight: 400;\"> cannot profane it, but others can for him. This process is known as <em>'<\/em><\/span><em><span style=\"font-weight: 400;\">hatarat nedarim<\/span><\/em><i><span style=\"font-weight: 400;\">'<\/span><\/i><span style=\"font-weight: 400;\">, and it is entrusted, first and foremost, to the experts. A person who ignored all the rabbinic warnings about careful speech, and foolishly made a vow that he now finds he cannot keep is not chastised for his carelessness, he isn't encouraged to valiantly try to live up to his vows, or empathized with. The role of the expert is to help him, by creatively finding an 'out'.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Once, it was lay people who added prohibitions, who demanded of themselves greater stringencies, and it was the role of the expert rabbis to make their lives livable when they got out of control. Somewhere along the way, rabbis and lay people seem to have gotten their roles reversed, and it is the rabbis who are always demanding stringencies that put people to the test and push them past the breaking point, and the people who desperately search for ways out. This reversal causes great anguish for all parties. \u00a0Instead of helping to keep people from profaning their word, and preventing <\/span><em><span style=\"font-weight: 400;\">hillul<\/span><\/em><i><span style=\"font-weight: 400;\">,<\/span><\/i><span style=\"font-weight: 400;\"> this type of rabbinate is the cause of great <\/span><em><span style=\"font-weight: 400;\">hillul<\/span><\/em><span style=\"font-weight: 400;\">.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But there is hope. Single women must approach their fathers and married women\u2014their husbands. Unspoken, albeit implicit, is that men may annul their own vows, although later, Talmudic, elaboration imposed the qualification that annulment must be undertaken in the presence of either a single expert judge or three laymen (to which anyone who has witnessed or participated in the annulment ceremony traditionally observed on the eve of Rosh Hashanah can attest).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Two fundamental questions have been posed about the chapter, one each by Rashi and his grandson Rashbam.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rashi asked: Why are the laws of vows addressed to the tribal chieftains? Rashbam asked: Where was Moses instructed to make this presentation?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rashi\u2019s answer is that Moses first instructed the tribal chieftains out of deference to their positions and responsibilities. In fact, Rashi inferred from this particular instance that this was SOP. In other words, anytime Moses provided instruction to the Jewish people, he first shared that teaching with the chieftains.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rashbam\u2019s answer is that the matter of vows and their annulment is an extension of the laws of festival offerings that are contained in the previous chapter. Indeed, the final verse of that chapter reads: \u201cThese shall be offered to God at the appointed times\u2014in addition to the offerings made by vows or in free-will\u2026\u201d (29:39). In order to insure prompt fulfillment of promised offerings, they were to be brought on one of the pilgrimage festivals, lest the lapse of time until their fulfillment lead to their abrogation.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">If we combine these two interpretations, we can infer a significant insight: While Judaism revels in its belief in individual free will, this does not absolve the leadership of the Jewish community from its corporate responsibility to properly oversee its members and to facilitate their fulfillment of their individual Deep significance attaches to vows and the other verbal undertakings: \u201cIf a man makes a vow to God, or makes an oath to obligate himself, he must not break his word. He must do everything he said\u201d (Num. 30:3). We laugh at jokes we don\u2019t find funny, we make sympathetic comments even to opinions we may not share, and we attempt to be liked by the people we are with at the moment. That desire to please is a heritage of our mammalian nature: neural pathways make sure to connect us to those nearby, linking our emotions, our responses, and even shading our opinions to keep us connected. We even yawn when those around us do.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">One of the main casualties of this human propensity to \u00a0be similar to those we are near is that we often say things that we might mean at the time, but which upon reflection we want to walk back. We make promises we cannot (or should not) keep; we commit to goals we don\u2019t really desire. Social exchanges are often so scripted that we provide clues for when our answer is socially driven rather than accurate. \u201cHow are you?\u201d \u201cOh, I\u2019m fine, thank you.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">What is lost in that social pleasantries, the little lies that lubricate our public lives, the small deceptions and duplicities we all indulge is the certainty of being able to rely on what others tell us. Not only can\u2019t we assume that they are telling us the truth, but we often knowingly assume that they are not.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The Torah invites us to a higher transparency. \u201cIf a person makes a vow to the Lord or takes an oath imposing an obligation on themselves, don\u2019t break the pledge; carry out all that has crossed your lips (30:3).\u201d Knowing that we have a propensity to say what people want to hear, the Torah commands us to do the work of committing ourselves, and of speaking only what we are willing to implement. That means a willingness to live with integrity even at the expense of always getting along. It requires us to weigh our promises and make them only if we are willing to follow through.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">At the price of momentary discomfort or disappointment, we create a world of integrity in which we can rely on each other. It is the absence of opposition. It may not be enthusiastic, but it \u00a0accepts because it does not need to deny. Silence gives the woman authority to make a binding obligation between herself and God.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In ancient times, a woman usually lived under the authority of her husband or father. Today, \u00a0when I look for an analogue, I think of the way our children live under parental authority. There is an important difference in these two scenarios of authority: children are always on a path to adulthood, whereas in ancient times, women might find themselves in situations of autonomy, but only under certain circumstances, not as a matter of course.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Nevertheless, the analogy allows us to consider when silence is called for as we take care of those entrusted to us, in a God-given universe. When adults care for and protect children, it is with the presumption that as children grow, increasingly more decisions will be theirs to make. The obligations they take upon themselves will bind them, not us. Their messes will be their own to clean up; their achievements, their own as well. When a child reaches the age of mitzvot, the \u201c<em>'ol mitzvot,\u201d<\/em> the yoke of commandments, is now theirs alone.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Each human being has a voice. A child has a voice.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Each human being has a will. And ideas. A religious person will have that voice, will, and ideas, in relation to God, as well as to other human beings.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Sometimes, when I hear my child\u2019s voice, then my voice \u2013 as a parent -- is called for in order to oppose, to limit, to deny my child\u2019s desires and impulses, to countermand their speech. When I must intervene to prevent, then I speak.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But at other moments, holy moments, when a child asserts his or her deepest self in a form that bears no harm, then maybe we need to be silent \u2013 \u201c<em>v\u2019heherish lah<\/em>.\u201d Let their words stand. Recognize their autonomy, their intention, their selfhood, a selfhood that comes into being through speech, but also through adult silence.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Not every act nor every speech act that a child practices needs parental commentary, not even approval or confirmation. Is this an indication of the rise of a new leadership as the narrative turns towards entering the land? Or is it because of the subject of the laws?<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Permission to rescind?<\/em> Permission - not obligation. A man has the power to rescind or retract a vow of his wife or daughter. He, of course, can honor it, and her. Something about the phrasing of \u201cand the LORD will forgive her\u201d sounds like God making peace with those situations when a man chooses not to honor her vow.\u00a0<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Time out.<\/em> According to the way the rabbis read these passages, a woman is fully responsible for her vows for the period beyond her \u201cyouth\u201d (<\/span><em><span style=\"font-weight: 400;\">ne'ureha<\/span><\/em><span style=\"font-weight: 400;\">), which ends at age 12, and her marriage.\u00a0<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>Law and order<\/em>. The chapter ends \u201cThose are the laws that the LORD enjoined upon Moses between a man and his wife, and as between a father and his daughter while in her father\u2019s household by reason of her youth\u201d (verse 17).
