Sociological?","post_main_content_content":"<p><span style=\"font-weight: 400;\">There is a great debate concerning the nature of \u201choliness.\u201d A literal interpretation of Lev. 20:26 would support a particular position in this controversy: \u201cYou shall be holy to Me, for I God am holy, and I have <\/span><i><span style=\"font-weight: 400;\">set you apart <\/span><\/i><span style=\"font-weight: 400;\">from other peoples to be Mine.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Bechor Shor explains this verse as referring primarily to relations with the surrounding nations:<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">\u2026If you do not separate from the ritually impure (<\/span><i><span style=\"font-weight: 400;\">see verse 25<\/span><\/i><span style=\"font-weight: 400;\">) you are like them (<\/span><em><span style=\"font-weight: 400;\">the other peoples<\/span><\/em><span style=\"font-weight: 400;\">), removed from Me. And if you separate yourself from the ritually impure, you are removed from them, and associated with Me\u2026<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In contrast, the Talmud states that <\/span><em><span style=\"font-weight: 400;\">imitatio dei <\/span><\/em><span style=\"font-weight: 400;\">manifests itself in the fulfillment of ethical,\u00a0 <\/span><span style=\"font-weight: 400;\"><em>interpersonal<\/em> <\/span><span style=\"font-weight: 400;\">commandments:<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Rabbi Chama, son of Rabbi Chanina, says: One should follow the attributes of the Holy One, Blessed be He. Just as 1) He clothes the naked\u2026 so too, should you clothe the naked. And as He, 2) visits the sick\u2026 so too, you visit the sick. He, 3) consoles mourners\u2026 so too, you console mourners. And He, 4) buried the dead\u2026 so too, you bury the dead (Sota 14a).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In addition, the verse in Leviticus 20:26 illustrates how in <\/span><i><span style=\"font-weight: 400;\">ritual <\/span><\/i><span style=\"font-weight: 400;\">matters, i.e. the laws of <\/span><span style=\"font-weight: 400;\"><em>kashrut<\/em> <\/span><span style=\"font-weight: 400;\">defined as part of the rules that govern the relationship between humans and God, Jews distinguish themselves from others by adhering to a regimen where some foods are permitted, and others forbidden.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">By extension, other topics listed in Leviticus 20, i.e., child sacrifice (vs. 2-5,) attempting to predict the future via individuals claiming such special powers (vs. 6, 27) not cursing one\u2019s parents who \u201ccreated\u201d you (v. 9,) and laws defining sexual immorality, regardless if those involved are consenting adults (vs. 10-21,) similarly demand the Jewish people behave differently from other nations.\u00a0\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Such an approach would contend that the caveat assumed by vs. 7-8 - \u201cYou shall sanctify yourselves and be holy, for I the Lord am your God. You shall faithfully observe My laws: I the Lord, make you holy\u201d - i.e., by observing both interpersonal and ritual commandments, results in the Jews becoming \u201ca kingdom of priests and a holy nation\u201d (Ex 19:6).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Meshech Chachmah suggests that verses 7-8 state that should the Jews comply with the Torah\u2019s laws in their entirety, God will cause their thoughts to complement their deeds:\u00a0\u00a0<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">\u00a0\u2026even if the powers of thought are not controlled by the individual, what should one do if the heart desires, and misleads the mind? After a detailed description of Molech worship and a general prohibition against going to soothsayers and necromancers, the chapter continues with a repeat of the forbidden relationships. What is the connection between these ideas?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Perhaps there is an implicit comparison here between idol worship and the forbidden relationships. The relationship between God and Israel is portrayed as a monogamous relationship. This relationship between the people and God is often described in marriage terms throughout Tanach. When the people worship idols, it is similar to a marriage being thrown into chaos by a forbidden relationship.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Likewise, after the list of forbidden relationships God warns:\u00a0<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">You shall faithfully observe all My laws and all My regulations, lest the land to which I bring you to settle in spew you out. You shall not follow the practices of the nation that I am driving out before you. For it is because they did all these things that I abhorred them\u201d (verses 22-23).\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Notice the language of exile mimics a broken relationship. The nations of the land, according to this, lack respect for their personal relationships and for their relationships with any deity. They marry whomever they want, and they worship many gods.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">God wants the Israelites to be different. Leviticus 19:18 reads, \u201cYou shall not take vengeance or bear a grudge against the children of your people, love your fellow as yourself, I am the Lord.\u201d<\/p>\r\n<p>Sefer Hachinuch tells us that to love Israel is mitzvah 243, and that \u201cthis mitzvah is observed in every place and in every time\u201d meaning that there is no time or place in which circumstances override it.\u00a0Sefer Hachinuch gives a common sense explanation of the command: \"The root of the commandment is well-known - as in the way that he acts to his fellow, so will his fellow act to him. And there will be peace among the creatures with this.\" It also tells us that\u00a0Rabbi Akiva said in the Sifra, 4:12 that this is a \u201cgreat principle in the Torah\u201d because so many other commandments are dependent upon it.\u00a0<\/p>\r\n<p>If we really consider the possessions and property along with the general well-being of others as we consider our own, we will have empathy for others.\u00a0 Once we have empathy, we can behave towards other people with the <em>chesed<\/em>, overflowing kindness, that is the hallmark of our goals as Jews.\u00a0 There are many emanations out from this central mitzvah.<\/p>\r\n<p>On the week we read this portion in the Diaspora we also celebrate the independence of Israel, on the fifth of Iyar.\u00a0In a state ostensibly set up to enable Jews to live out Jewish values, following the dictate of loving fellow Jews in order to create and increase holiness must continue to be the central mission.\u00a0Jews everywhere have the opportunity to practice and live the values of holiness but those living in Israel are empowered to do so on a vaster communal level, as well as an individual one.\u00a0<\/p>\r\n<p>We can only hope that studying the code for holiness continues to lead us to act in ways that behoove us to call ourselves people who strive for empathy, the core of holiness, as the mitzvah of loving our neighbor as ourselves At the time, I had no idea that this double portion would come to mean so much to me. Leviticus 18:22 and 20:13 came to have their full caustic power on my life, when I was a closeted Orthodox rabbi living in Riverdale, New York, and involved in my first gay relationship. The high wire anxiety of this time led me to a showdown of sorts. I needed to make some sense of these verses in order to continue in good faith, not only as an Orthodox rabbi, but as a committed Jew.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">I spent roughly the next ten years working on the emotional, intellectual, legal and spiritual ramifications of these two verses. My efforts eventually became a book released in 2004 and entitled: <\/span><i><span style=\"font-weight: 400;\">Wrestling with God and Men: Homosexuality in the Jewish Tradition.<\/span><\/i><\/p>\r\n<p><i><span style=\"font-weight: 400;\">\u201cAnd with a male you shall not lie the lyings of a woman, it is an abomination.\u201d<\/span><\/i><span style=\"font-weight: 400;\"> Rabbinic reading focused this verse on a single act between men, namely, anal intercourse. Lesbian relations are mentioned nowhere in scripture. Remarkably, the Torah is utterly uninterested in \u201chomosexuality.\u201d The sameness of the sexes (homo=same) that dominates contemporary thought is missing here.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">So what is it about anal sex between men that is such a problem?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">One of the best avenues for understanding the meaning of any law is an exploration of the stories that provide the law with narrative contexts. According to the midrash, Noah\u2019s son Ham does not merely see his father naked and drunk in his tent, but either castrates or anally rapes his father but the most overt biblical depiction of male-male sexual relations is the story of the destruction of Sodom. The aim of the mob in Sodom, according to the rabbis, was humiliation as punishment or sport, but not sexual fulfilment.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Read in this way, the verse in Leviticus 18 might well be prohibiting sex as an expression of power and humiliation while leaving sex between committed and loving partners permitted.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Since the prohibition follows a long list of incest prohibitions with related women, one scholar has suggested that the verse might be coming to prohibit sex with all one's male family members as well.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Lastly, according to Rabbi Ishmael in the Talmud, only the penetrating partner violates the rule in Leviticus. The receptive partner, he claims, is liable under a different verse in Deuteronomy (23:18) that prohibits temple prostitution.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">These readings leave open the sort of sexual relations that occur outside of the circle of family relations, that are conducted without violence or humiliation and are not associated with the dramaturgy of pagan rites. Read in this way, love between men that is marked instead by care and commitment would seem not only permitted, but potentially holy.<\/span><\/p>\r\n<p>image I am<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">the man I am, the very man that You<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">created, so must demons of despair<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">attack me now? \u00a0I ask You not to slam<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">the closet door; let in a bit of blue,<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">a bit of red, let in some light, some air.<\/span><\/p>\r\n<p>&nbsp;<\/p>\r\n<ol>\r\n\t<li><i><span style=\"font-weight: 400;\">Mincha<\/span><\/i><\/li>\r\n<\/ol>\r\n<p><span style=\"font-weight: 400;\">I'm not the man the Torah wanted me<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">to be, the man my father's prayerbook thought<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">I should become. \u00a0You see how shadows caught<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">me when I tried to wear a mask, You see<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">they brought a Mirror of Integrity<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">and made me see myself. \u00a0They also brought<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">me books from the Closet Printing Press which taught<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">me tenets of eventide theology.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The shadows showed me that before I pray<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">I need to face the truth about myself.<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">Although I may not be the person who<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">recites my father's prayers, although I may<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">be someone else, upon my closet shelf<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">a prayerbook sits with prayers I write to You.<\/span><\/p>\r\n<p style=\"padding-left: 30px;\"><span style=\"font-weight: 400;\">III. <\/span><i><span style=\"font-weight: 400;\">Ma'ariv<\/span><\/i><\/p>\r\n<p><span style=\"font-weight: 400;\">A closet's path may lead one far away \u2014<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">the closet path I'm walking on has led<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">me far away from You. \u00a0Although I've said<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">my prayers today, this doesn't mean I pray,<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">this doesn't mean I mean the words I say,<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">it only means I've mouthed the words I've read.<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">At night I wonder, as I lie in bed,<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">if You indeed accept the fact I'm gay.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">You know of course that I'm a hypocrite,<\/span><span style=\"font-weight: 400;\"><br \/>\r\n<\/span><span style=\"font-weight: 400;\">You know that I'm a coward, too. Beginning with eating, ending with sex, those most basic of human activities, and covering everything else in between, the Torah now dedicates the final verses of chapter 20 to neatly wrapping up this unit, reminding us of important points that were made along the way, and repeating its central thesis. A literary structure that would make any writing professor proud.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Until verse 27 destroys it. \"A man or a woman who has with them an Ov or Yidoni shall surely die, they will be stoned, their blood is upon them.\" A law about fortune telling or necromancy that stuck out like a sore thumb earlier in the chapter, now thumbs itself at the Torah's lovely structure. This is either the work of a drunken editor, or there's something the Torah wants us to learn here.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Chapter 20 is full of infractions whose punishment is death, but every single one of them has to do with the violation of a relationship. There is, however, one word which tenuously connects the law forbidding fortune-telling to this theme. When it is first mentioned, in verse 6, the Torah speaks about the one who turn after the Ov or Yidoni \"<\/span><b><i>liznot<\/i><\/b><i><span style=\"font-weight: 400;\"> achareihem<\/span><\/i><span style=\"font-weight: 400;\">\" (\u201cgoes astray\u201d). We are familiar with this root in the context of idol worship; idol worship is seen as \"cheating on\" God by being loyal to another deity. But that can't be the meaning here- in this verse, we're not talking about worshipping another god at all, only about using sorcery to find out our future. What's unfaithful about that?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">To go to a fortune teller is a betrayal of our ability to choose, an escape to the comforting ease of fate. We suggested in chapter 18 that the problem with incest can be understood as a similar betrayal- building a relationship on existing biological closeness rather than choosing to forge a bond with a true 'other'. Holiness, the Torah is teaching us, is about making a choice.<\/span><\/p>\r\n<p>image: However, when his final battle against the Philistines began to turn against him and he experienced a premonition of his own death, Saul approached a sorceress (<\/span><em><span style=\"font-weight: 400;\">ba`alat \u2018Ob<\/span><\/em><span style=\"font-weight: 400;\">) of Ein-Dor and asked her to raise up for him the spirit of Samuel the prophet (1 Samuel 28:7 ff.).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The woman complied and raised up \u201can elderly man wrapped in a cloak\u201d (v. 14) whom Saul recognized as Samuel. God\u2019s call to Abram is, among other things, a call <em>to <\/em><\/span><em><span style=\"font-weight: 400;\">be different<\/span><\/em><span style=\"font-weight: 400;\">. He is to uproot himself from all the normal bases of identity (parents, birthplace, land). He and his descendants will be unique. They will become the only nation whose identity is founded not on \u201cnatural\u201d factors but on a specific covenant with God. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The first sign of that covenant is circumcision. Later, with the exodus and the revelation at Sinai, Israel will become the people whose way of life and historical destiny testify to the presence of God in their midst. As opposed to the nations and empires of the ancient world, their identity will not be \u201corganic\u201d or \u201ccosmological\u201d but covenantal. They are called on to be different:<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">You shall be holy to Me, for I, God, am holy, and I have separated you out from among the nations to be Mine. (Leviticus 20:26.) <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Now if you obey Me and keep My covenant, you shall be My special treasure among all the nations, even though all the world is Mine. You will be a kingdom of priests and a holy nation to Me. (Exodus 19:5-6.)<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Do not follow the ways of Egypt where you once lived, nor of Canaan, where I will be bringing you. Do not follow their customs. In verse 17 forbidden relations between brother and sister are described as <\/span><i><span style=\"font-weight: 400;\">hesed<\/span><\/i><span style=\"font-weight: 400;\">: \u201cIf a man marries his sister, the daughter of either his father or his mother, so that he sees her nakedness and she sees his nakedness, it is a <\/span><i><span style=\"font-weight: 400;\">hesed,<\/span><\/i><span style=\"font-weight: 400;\"> disgrace\u2026\u201d As opposed to its conventional meaning as \"grace,\" this meaning of <\/span><i><span style=\"font-weight: 400;\">hesed<\/span><\/i><span style=\"font-weight: 400;\"> is understood from its use in Akkadian and Syrian, where it means abasement, shame and disgrace.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><em>The feminine side<\/em>. The prohibitions on sexual relations in this chapter, as in chapter 18, focus on the men. Commandments relating to female actors can be found in verses 16-18.\u00a0<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\" aria-level=\"1\"><em>Distinction (havdalah<\/em><span><em>). <\/em>To set apart is a new term, a new equation in the context of laws of holiness: \u201cSo you shall set apart the clean beast from the unclean, the unclean bird from the clean.
