As compared with chapter 18, the list of laws is not introduced by legal categories, but with a call to lead a holy life. The concept of holiness was not very prevalent in the Torah until the book of Exodus, though the first mention of it is way back in the first story of creation. “And God blessed the seventh day and declared it holy—having ceased on it from all the work of creation that God had done” (Genesis 2:3). It is no surprise then that the very first law in this chapter talks about shabbat. “You shall each revere your mother and your father, and keep My sabbaths: I am The Lord your God” (verse 3).

The next mention of holiness is when Moses sees the burning bush. From the opening of Genesis until the Exodus, only days and land are given the distinction of holiness.

It is not until the giving of the Ten Commandments that God uses the word for holiness to refer to the nation. God uses some form of holiness to refer to the people four times during chapter 19 of Exodus. The highlight is the pronouncement that “you shall be to Me a kingdom of priests and a holy nation” (Exodus 19:6). Mentions of holiness explode following the Ten Commandments and during the building of the Mishkan.

Chapter 19 of Leviticus offers something unique, though. At no point before chapter 19 does God tell the people that they should be holy because God is holy. This chapter is the means to achieve the pronouncement of Exodus 19:6. The laws are not arbitrary pronouncements or even civil enactments as described in the previous chapter. The laws are meant to model the type of special holy life that God leads. It also provides dual motivations for the people. They can choose to follow the laws from a strict legal motivation, or they can follow the laws from a holistic desire to be holy like God.

https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg.jpg
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg-150x150.jpg
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg-300x225.jpg
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg-768x576.jpg
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg.jpg
1536x1536":"https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg.jpg","1536x1536-width":960,"1536x1536-height":720,"2048x2048":"https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg.jpg","2048x2048-width":960,"2048x2048-height":720
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg.jpg
https://cetwpuploads.blob.core.windows.net/wp929/uploads/2018/10/62724c78b3d69-62724c78b3d6bex15-milim-kodesh-holy.jpg-560x420.jpg
First holy time. If you want to understand what kinds of conduct Judaism cares about, read Leviticus 19. We care about Shabbat and interpersonal relationships. We care about how beards are maintained and how fruit trees are utilized. And the closing lines of the chapter state: "You shall not falsify measures of length, weight, or capacity. You shall have an honest balance, honest weights, an honest ephah, and an honest hin. There may be very many wronged parties, not all of whom the dishonest shopkeeper can identify if he or she wishes to make restitution.

The placement of this law at the end of the chapter might also give us a clue as to its significance. Here, the small Hebrew prefix letter “le-” indicates the indirect object, and literally means “You shall love to your fellow.” This is as strange in Hebrew as it is in English: if you love, say, chocolate, you would say “Ani ohev shokolad,” never “ani ohev le-shokolad.”

Perhaps this “problem” though is actually a solution to the first question. Are we only commanded to love Jews? This problem is also solvable, because even if the intent here is restrictive, only 16 verses later in the same chapter the exact same phrasing is used to refer to the ger, the foreigner: “The stranger who resides with you shall be to you as one of your citizens - ve-ahavta lo kamocha - you shall love him as yourself, for you were strangers in the land of Egypt” (19:34). Holiness in chapter 19 is overwhelmingly defined as things we don't do, not things that we must do. Even statements which are not phrased negatively are understood this way. To safeguard the Shabbat is expressed by observing its negative commandments, to fear one's parents and honor the elderly are expressed by not sitting in their place, interrupting them or contradicting them. These are not a technological innovation akin to the much-maligned Google Glass or, indeed, a downbeat counterpoint to the aforementioned rose-tinted goggles, whereby the wearer sees persecution around every corner. Rather, as is evident in this chapter, they are an attitude, a state of mind, a way of viewing the world, which can potentially raise mundane life issues to holiness.

Recently, as I was sitting opposite a bat mitzvah student who was struggling to understand the big picture of Judaism, I explained about the J-TS. The parasha reviews many commandments regarding a holy life, including: to honor one’s parents; to observe the Sabbath; to love and respect one’s neighbor; not to steal or exploit the weak; to pay a worker’s wages on time; not to practice injustice in court; and not to cross-breed animals or seeds or mix fabrics, thus keeping them separate as God created them.

In his painting, Avner Moriah visualizes the commandment of the orlah (uncircum-cised) fruits, not to eat the fruit of a tree during its first three years of growth: “Plant any tree for food… Three years it shall be forbidden for you not to be eaten; in the fourth year all its fruit shall be set aside for jubilation before the Lord” (Lev. 19:23–24).

We see an Israelite on his knees holding a young sapling. He is wearing a garment with many stripes alluding, perhaps, to the manifold duties described in this text. In the background we see the yellow hills of the desert, but the man is kneeling in a white area, undefined both geographically and temporally. Although he is clearly still in the wilderness, the man is apparently about to plant the sapling, the branches perhaps alluding to its first three years of growth, thus hinting at the future: “When you enter the Land.”

Why, among all the laws detailed in this parasha, did the artist choose to illustrate the orlah fruit prohibition? How does this commandment express holiness and being like God? Why does the Torah refer to the fruit from the early years of a tree as orlah – uncircumcised?

The image of the lone man reverently holding a sapling can take us back to the story in Genesis where man was created in God’s image and He “placed him in the garden of Eden to till it and tend it” (Gen. 2:15). From the beginning, man was given freedom, but with the obligation to take care of the land and not eat from the one tree that was dedicated to God. The dedication of the orlah fruits to the Lord represents a bond with God, similar to the Brit Milah: “Circumcise the flesh of your foreskin and that shall be the sign of the covenant between Me and you” (Gen. 17:11).

The artist focuses here on the holiness of man’s obligation to maintain and cherish God’s creation. Man was to take care not to exploit the land and its trees, and was to dedicate his early fruits to God. Allowing young trees to mature for three years ensured that they would yield good fruit in plenty after the fourth year: “And only in the fifth year may you use its fruit – that its yield to you may be increased” (Lev. 19:25).

30 So demanding are the Torah’s commandments that we cannot but fall short some, even much, of the time. God asks us in some sense to be like Him (“Be holy for I, the Lord your God, am holy” [Lev. 19:2). Yet how can we be equal to such a challenge when we are, and know we are, human, all too human? How can we fail to disappoint Him? Better surely to accept what we are than aspire to be better than we are. Yet this is a recipe for faint hearts and small spirits, and it is a route Judaism never took. Better to fail while striving greatly than not to strive at all.

Judaism’s resolution to this tension is so radical that it transformed the moral horizons of humankind. It says that the God of love and forgiveness created us in love and forgiveness, asking that we love and forgive others. God does not ask us not to fail. Rather, He asks us to acknowledge our failures, repair what we have harmed, and move on, learning from our errors and growing thereby. Human life, thus conceived, is neither tragic nor mired in sin. But it is demanding, intensely so. Therefore at its heart there had to be an institution capable of transmuting guilt into moral growth, and estrangement from God or our fellow humans into reconciliation. That institution is Yom Kippur, when in total honesty we fast and afflict ourselves, confessing our failures and immersing ourselves, mystically and metaphorically, in the purifying waters of
