Radak echoes Rashi\u2019s reasoning and adds that she was also listed as the daughter of Jacob to explain that she was raped as punishment to Jacob based on a midrash from chapter 32. In that chapter, Dinah is missing from the count of the children of Jacob before he meets Esau. The Midrash explains that Jacob placed Dinah in a box to keep her from Esau. Jacob is punished because by doing so he prevented Esau from a chance to repent by not forcibly taking Dinah as a wife.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">These three opinions all seem to blame Dinah for the fact that she was raped.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Malbim disagrees with the victim blaming. But some did. Maybe you guessed that there was more to me than the voiceless cipher in the text. Maybe you heard it in the music of my name. Dee-nah. The first vowel high and clear, as when a mother calls to her child at dusk; the second sound soft, for whispering secrets on pillows.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">No one recalled my skill as a midwife or the songs I sang or the bread I baked for my insatiable brothers. Nothing remained except a few mangled details about those weeks in Shechem.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">There was far more to tell. Had I been asked to speak of it, I would have begun with the story of the generation that raised me, which is the only place to begin. If you want to understand any woman you must first talk about her mother and then listen carefully. Stories about food show a strong connection. Wistful silences demonstrate unfinished business. Someone who likes to hang out on the streets? A prostitute? Leah\u2019s daughter? Jacob\u2019s daughter? Someone\u2019s sister?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">I know so little about you. Throughout the entire chapter you are silent, mute, dumbfounded, hidden. At first you were active, you went out to see! But instead of seeing, you were seen, and in one moment they kidnapped you, raped you, abused you, talked at your heart (not to your heart but at it), and then they took revenge because of you, and then took you again, spoke about you, and that is it.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Your brothers asked, \"Should our sister be treated like a whore?\" (Genesis 34:31). \u00a0\u00a0And sad to say but the answer is yes. Our Sages said that you were a whore like your mother. Rashi on Genesis 34:1 brings this midrash in his commentary, and since then every little kid quotes Rashi saying you are \"a prostitute whose mother is a prostitute.\u201d<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">But do not listen to them Dina. Do not let these words hurt you. Thousands of years have passed since Shechem allowed himself to take your body, and we are here to return it to you. We are here to give you a presence, a voice, a face.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">We will remember you, Dina. Dina the daughter of Leah, whom she bore to Jacob. Dina with the brunette hair, the brown hair, or the black hair ... with the blue eyes, or the brown eyes, or the green ones... Dinah the tall one, the short one, the proud one, the wise one, the perceptive one, the brave one, beautiful Dina. Jacob had twelve children at this point -- eleven boys plus Dinah. The midrash claims eleven is written because Jacob hid Dinah in a box so Esau would not seek to marry her. Jacob was so afraid of his twin\u2019s animal appetites that he concealed Dinah in a coffin to keep her safe.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">That may seem ironic when we reach the very next story in our chapter: Dinah heads out to visit with the local ladies. Shechem, the son of the local prince, sees her, grabs her, and rapes her.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Throughout the ensuing narrative, Dinah never speaks. \u00a0Shechem, the rapist speaks, as does his father. Jacob\u2019s sons talk, as does Jacob. But Dinah\u2019s voice is entirely absent.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Think of all the times and places in human history when women haven't been able to tell our stories. That silencing constricts freedom as surely as Jacob's box constricted Dinah. The people and the structures of power responsible for silencing us may think they're keeping us \"safe\" -- but we see from the Torah that keeping a woman hidden or silent offers no protection.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">How might have her story been different if Dinah had participated wholly in the journeying of her family -- if, like her brothers, she had been able to walk freely in the open air -- if, like her brothers, she had been given a voice to speak out or talk back? How might our stories be different if every woman in the world were granted those freedoms as a matter of course? Tragically, Dinah's story challenges us with its very familiarity. A woman rendered invisible and silent.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Some of the structures which silence women today are invisible. Societal expectations, peer pressure, the desire to be liked, the fear that if we speak what's true for us we will be shunned or left alone -- not to mention the outrage and active silencing coming from men who don't like it when we get uppity. Around the world one in three women\u00a0has been abused, beaten, or coerced into sex. And most of these stories are never told, because girls are taught -- in ways both obvious and subtle -- that if we speak out, we will be punished further. We have learned that it is safer to remain silent.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Let\u2019s honor Dinah, the silent twelfth child of Jacob, by changing the world we live in so The words 'son', 'daughter' and 'father' recur 31 times in the 31 verses of chapter 34. Apparently, the awful events of the chapter revolve around parents and children, and especially, what can happen when parents are run by their children, by providing too much autonomy, or too much support. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jacob and Hamor, the two fathers who cast themselves into supporting roles in the story, personify each extreme. On the one hand, parents can grant too much autonomy to their children, letting them be the masters of their own fate, make their own decisions and their own mistakes, and thereby let their children's decisions, informed by passion, unfettered by the careful measuring of consequences, determine events. This is Jacob, who allows Dinah to wander unaccompanied in an unknown city (contrast this with the precautions taken by Abraham and Isaac in Egypt and Gerar), and who does not utter a single word until the very end of the chapter, leaving it entirely up to his sons to determine the reaction to Dinah's rape. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">On the other hand are parents who can't relinquish their ownership over their children's wellbeing, but who provide for them based on the children's own sense of their needs. This is Hamor, the dedicated father who has named the city after his son, who will allow his entire town to undergo \"minor surgery\" in order to satisfy his son's infatuation. Rather than help his son, the text emphasizes that Hamor thus infantilizes him.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Simeon and Levi commit the massacre in Shechem, and ultimately they will be cursed for it, but it is two well-intentioned fathers who create the circumstances which enable it. The Question Presented is whether the defense of \u201cjustifiable homicide\u201d and other factual circumstances entitled the Appellants to acquittal on all charges or, at least, on the allegation that they committed murder in the first degree.<\/span><\/p>\r\n<p style=\"text-align: center;\"><b>ARGUMENT<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>I.<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>KILLING \u201cIN THE HEAT OF PASSION\u201d<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>IS, AT MOST, VOLUNTARY MANSLAUGHTER<\/b><\/p>\r\n<p><span style=\"font-weight: 400;\">The evidence did not prove beyond a reasonable doubt that the Appellants lacked legal \u201cjustification\u201d for their actions. Their sister had been raped and was being held prisoner by Shechem, Hamor, and their cohorts. The Appellants conspired to weaken those who held Dinah, but their objective was to free her. Although the Appellants\u2019 brothers took booty from the city and from the victims, the Appellants did not. Hence their conduct was committed in the \u201cheat of passion\u201d and was, at most, voluntary manslaughter.<\/span><\/p>\r\n<p style=\"text-align: center;\"><b>II.<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>DEADLY FORCE WAS NECESSARY TO SECURE<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>THE RELEASE OF APPELLANTS\u2019 KIDNAPPED AND RAPED SISTER<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>AND TO PROTECT THE APPELLANTS\u2019 FATHER<\/b><\/p>\r\n<p><span style=\"font-weight: 400;\">Evidence established that the followers of Shechem came to their ruler\u2019s defense with force (<\/span><em><span style=\"font-weight: 400;\">Or HaChaim<\/span><\/em><span style=\"font-weight: 400;\">), and that they intended to kill the Appellants\u2019 father Jacob and seize his assets (<\/span><em><span style=\"font-weight: 400;\">Malbim<\/span><\/em><span style=\"font-weight: 400;\">). Hence the Appellants could not secure Dinah\u2019s release or their father\u2019s safety without battling and killing all the males of the city, including Shechem and Hamor. The Appellants were engaged in self-defense, as well as in a legitimate effort to secure the release of a captive.<\/span><\/p>\r\n<p style=\"text-align: center;\"><b>III.<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>SHECHEM AND HIS FOLLOWERS WERE TOTALLY<\/b><\/p>\r\n<p style=\"text-align: center;\"><b>LAWLESS AND WERE LEGALLY \u201cPIRATES\u201d SUBJECT TO DEATH<\/b><\/p>\r\n<p><span style=\"font-weight: 400;\">Shechem was the ruler of a totally lawless society that failed to punish wrongdoers, including his son Hamor (<\/span><em><span style=\"font-weight: 400;\">Rambam<\/span><\/em><span style=\"font-weight: 400;\">).<\/span> <span style=\"font-weight: 400;\">Hence he and his followers were enemies of mankind, as the US Supreme Court characterized pirates in an 1844 decision (<\/span><em><span style=\"font-weight: 400;\">Harmony v. God, who until now accompanied Jacob closely, while he was still in his mother\u2019s womb, through his struggle with brother Esau about the birthright, the long exile in Haran and the complex relationship with his Laban and his daughters until his fateful encounter with his brother, disappears in an instant, specifically at a time when we are talking about one of the most frightening episodes in Jacob\u2019s life until now. \u00a0It is an episode that begins with the rape of his daughter and ends with the revenge of his sons.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Where was God at the time of Dina's rape? Where was God at the time when her brothers plotted their revenge? Where was God at the time when they had committed their scheme? Where was God after their act of revenge was done?<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\"> Was God there at the moment of circumcision or the time when Hamor and the innocent people of his city were commanded \u201c<\/span><b>every male among you is circumcised<\/b><span style=\"font-weight: 400;\">\u201d (Genesis 34:15), before they became easy prey in the hands of Jacob's sons? This was the same act of circumcision Abraham was commanded by God to perform with exactly the same words - \u201c<\/span><b>every male among you shall be circumcised<\/b><span style=\"font-weight: 400;\">\u201d (Genesis 17:10), as a sign of the covenant between them. This is the covenant in which God promised Abraham progeny and a land, separateness and election. This is the same act of circumcision that Tzipora performed on her son in order to protect Moses from God who was plotting to kill him (Exodus 4:25).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Apparently, circumcision managed to protect us from strangers and even from God, but it did not manage to protect us from But, the text also makes it clear that however it began, he quickly fell for her. (Whether she ever reciprocated - or whether it was an actual rape in the first place and not just described as such to negate Dinah\u2019s possible role in the matter, and to justify the honor killings perpetrated later, are all fertile fodder for the midrashic imagination). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The text says not only that he loved her, but even <\/span><em><span style=\"font-weight: 400;\">vatidbak nafsho<\/span><\/em><i><span style=\"font-weight: 400;\">, <\/span><\/i><span style=\"font-weight: 400;\">that \u201chis soul clung to her.\u201d This is the same word used in Genesis 2:24 to describe the ideal relationship between a man and his spouse: \u201cHence a man leaves his father and mother <\/span><em><span style=\"font-weight: 400;\">vedavak beishto<\/span><\/em><i><span style=\"font-weight: 400;\">, <\/span><\/i><span style=\"font-weight: 400;\">and clings to his wife, so that they become one flesh.\u201d <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The word includes both an emotional component and a physical one, for it is also the same word that is used to describe how Ruth behaved towards Naomi: \u201c<\/span><em><span style=\"font-weight: 400;\">ve-rut davka bah<\/span><\/em><span style=\"font-weight: 400;\">, and Ruth clung to her\u201d (Ruth 1:14). As for Shechem, nothing could sound more pure and sincere.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In the same way that people can cling to each other, a person can cleave to God: \u201cYou must revere the LORD your God: only Him shall you worship, <\/span><em><span style=\"font-weight: 400;\">ubo tidbak<\/span><\/em><i><span style=\"font-weight: 400;\">,<\/span><\/i><span style=\"font-weight: 400;\"> to Him shall you hold fast, and by His name shall you swear\u2026\u201d (Deut 10:20; see also Deut 13:5). And also in a verse known from the liturgy: <\/span><i><span style=\"font-weight: 400;\">\u201c<\/span><\/i><em><span style=\"font-weight: 400;\">Ve'atem hadveikim badonai<\/span><\/em><i><span style=\"font-weight: 400;\">,<\/span><\/i><span style=\"font-weight: 400;\"> while you, who held fast to the LORD your God, are all alive today\u201d (Deut 4:4).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The idea of a very physical clinging to God in Kabbalah and Hassidism became an entire theology known as <\/span><em><span style=\"font-weight: 400;\">dveikut<\/span><\/em><span style=\"font-weight: 400;\">, striving for a transcendent spiritual closeness with God, even a sort of <\/span><span style=\"font-weight: 400;\"><em>unio mystica<\/em> <\/span><span style=\"font-weight: 400;\">with the divine. Another kabbaslitic use of this word, though in a different vein entirely, is when an evil spirit clings to a person, a sort of demonic possession, known as a <\/span><em><span style=\"font-weight: 400;\">dybbuk<\/span><\/em><span style=\"font-weight: 400;\">, made popular in the play by S. Ans-ky of that name.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Another fraught, negative use in a very different context is the well-known Psalm 137 (you know, the one by Bob Marley): \u201cBy the rivers of Babylon, there we sat, sat and wept, as we thought of Zion\u2026If I forget you, O Jerusalem, let my right hand wither; <\/span><span style=\"font-weight: 400;\"><em>tidbak leshoni<\/em> <\/span><span style=\"font-weight: 400;\">let my tongue stick to my palate if I cease to think of you\u201d (vv.1,5-6). That meaning is much closer to paralysis than transcendence. <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">In Modern Hebrew, as with many spiritually rich traditional terms, the root has been secularized into everyday use. <\/span><em><span style=\"font-weight: 400;\">Devek<\/span><\/em><span style=\"font-weight: 400;\"> is \u201cglue,\u201d <\/span><span style=\"font-weight: 400;\"><em>davik<\/em> <\/span><span style=\"font-weight: 400;\">is \u201csticky,\u201d <\/span><em><span style=\"font-weight: 400;\">madbeka<\/span><\/em><span style=\"font-weight: 400;\"> is a \u201csticker\u201d (though David Grossman\u2019s powerful political song, sung by Dag Nachash, where he strings together the messages and slogans of bumper stickers from right and left is called <\/span><em><span style=\"font-weight: 400;\">Shirat Ha-stikker<\/span><\/em><span style=\"font-weight: 400;\">), and the most fraught or negative form of the root is <\/span><em><span style=\"font-weight: 400;\">middabek<\/span><\/em><span style=\"font-weight: 400;\">, which also means something \u201csticky - i.e., a condition which is \u201ccontagious.\u201d Like certain He talks to her (and we are not told what she said), and asks his father to take action.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The official marriage proposal comes in verses 8-12, and is in fact a proposal for the establishment of good neighborly relations with the people of Shechem, including: marriage ties between the two communities, dwelling together and commerce.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jacob, who already in verse 5 when he heard about the silent matter, says nothing. The person who leads the discourse is his sons, Dinah's brothers. \"Jacob\u2019s sons answered Shechem and his father Hamor--speaking <\/span><b>with guile<\/b><span style=\"font-weight: 400;\"> because he had defiled their sister Dinah \" (verse 13). They base their acceptance of the (widespread) marriage proposal on the condition that the people of Shechem circumcise themselves.<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">The proposal sounds perfectly reasonable to Shechem and his father, and they convince the people of their city to accept it. Then on the third day after circumcision, when the people of Shechem were still on a brief medical leave, \u201cSimeon and Levi, two of Jacob\u2019s sons, brothers of Dinah, took each his sword, came upon the city unmolested, and slew all the males\" (verse 25), and no less importantly, rescued Dinah from the house of Shechem, and afterwards took all the spoils possible (verses 27-29).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Jacob, who was silent the whole chapter, says in verse 30, \u201cyou have brought trouble on me, making me odious among the inhabitants of the land.\u201d Moreover, he says, you have endangered us all \u00a0\u201cif they unite against me and attack me, I and my house will be destroyed\u201d (verse 30). <\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Simon and Levi have a different set of considerations, and they do not remain obligated, \u00a0and with their statement the chapter ends: \u201cshould our sister be treated like a whore?\u201d (verse 31).<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Points to Ponder:<\/span><\/p>\r\n<ol>\r\n\t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dina, around whom the whole story revolves, gets different nicknames in the chapter. It is worthwhile to follow when she is called \"a maiden,\" \"a girl,\" \"Jacob\u2019s daughter,\" \"their sister.\u201d<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Verse 7: \"he had committed an outrage in Israel\" is an expression that is ahead of its time in the sense that the verse refers to \u201cIsrael\u201d as a nation whereas up until this time \u201cIsrael\u201d is used as Jacob\u2019s new name), but its use sets a category for things that are not done.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The democratic character of Shechem is revealed in the manner in which Shechem and his father put forward the decision on the circumcision of all men - \"So Hamor and his son Shechem went to the public place of their town and spoke to their fellow townsmen, saying, (verse 20)....All who went out of the gate of his town heeded Hamor and his son Shechem, and all males, all those who went out of the gate of his town, were circumcised\u201d (verse 24). \u00a0This is not some royal decree but a persuasive speech.<\/span><\/li>\r\n\t<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">In this chapter Simeon and Levi get the last word. But the last word in the whole episode is reserved for Jacob.
