That is why I became a footnote, my story a brief detour between the well-known history of my father Jacob, and the celebrated chronicle of Joseph, my brother<\/span>.<\/b><\/p>\r\nOn the rare occasions I was remembered, it was as a victim. Near the beginning of your holy book, there is a passage that seems to say I was raped and continues with the bloody tale of how my honor was avenged.<\/span><\/p>\r\nIt\u2019s a wonder a mother ever called a daughter Dina again. But some did. Maybe you guessed that there was more to me than the voiceless cipher in the text. Maybe you heard it in the music of my name. Dee-nah. The first vowel high and clear, as when a mother calls to her child at dusk; the second sound soft, for whispering secrets on pillows.<\/span><\/p>\r\nNo one recalled my skill as a midwife or the songs I sang or the bread I baked for my insatiable brothers. Nothing remained except a few mangled details about those weeks in Shechem.<\/span><\/p>\r\nThere was far more to tell. Had I been asked to speak of it, I would have begun with the story of the generation that raised me, which is the only place to begin. If you want to understand any woman you must first talk about her mother and then listen carefully. Stories about food show a strong connection. Wistful silences demonstrate unfinished business. But instead of seeing, you were seen, and in one moment they kidnapped you, raped you, abused you, talked at your heart (not to your heart but at it), and then they took revenge because of you, and then took you again, spoke about you, and that is it.<\/span><\/p>\r\nYour brothers asked, \"Should our sister be treated like a whore?\" (Genesis 34:31). \u00a0\u00a0And sad to say but the answer is yes. Our Sages said that you were a whore like your mother. Rashi on Genesis 34:1 brings this midrash in his commentary, and since then every little kid quotes Rashi saying you are \"a prostitute whose mother is a prostitute.\u201d<\/span><\/p>\r\nBut do not listen to them Dina. Do not let these words hurt you. Thousands of years have passed since Shechem allowed himself to take your body, and we are here to return it to you. We are here to give you a presence, a voice, a face.<\/span><\/p>\r\nWe will remember you, Dina. Dina the daughter of Leah, whom she bore to Jacob. Jacob had twelve children at this point -- eleven boys plus Dinah. The midrash claims eleven is written because Jacob hid Dinah in a box so Esau would not seek to marry her. Jacob was so afraid of his twin\u2019s animal appetites that he concealed Dinah in a coffin to keep her safe.<\/span><\/p>\r\nThat may seem ironic when we reach the very next story in our chapter: Dinah heads out to visit with the local ladies. Shechem, the son of the local prince, sees her, grabs her, and rapes her.<\/span><\/p>\r\nThroughout the ensuing narrative, Dinah never speaks. \u00a0Shechem, the rapist speaks, as does his father. Jacob\u2019s sons talk, as does Jacob. But Dinah\u2019s voice is entirely absent.<\/span><\/p>\r\nThink of all the times and places in human history when women haven't been able to tell our stories. That silencing constricts freedom as surely as Jacob's box constricted Dinah. The people and the structures of power responsible for silencing us may think they're keeping us \"safe\" -- but we see from the Torah that keeping a woman hidden or silent offers no protection.<\/span><\/p>\r\nHow might have her story been different if Dinah had participated wholly in the journeying of her family -- if, like her brothers, she had been able to walk freely in the open air -- if, like her brothers, she had been given a voice to speak out or talk back? How might our stories be different if every woman in the world were granted those freedoms as a matter of course? Tragically, Dinah's story challenges us with its very familiarity. A woman rendered invisible and silent.<\/span><\/p>\r\nSome of the structures which silence women today are invisible. Societal expectations, peer pressure, the desire to be liked, the fear that if we speak what's true for us we will be shunned or left alone -- not to mention the outrage and active silencing coming from men who don't like it when we get uppity. Around the world one in three women\u00a0has been abused, beaten, or coerced into sex. And most of these stories are never told, because girls are taught -- in ways both obvious and subtle -- that if we speak out, we will be punished further. We have learned that it is safer to remain silent.<\/span><\/p>\r\nLet\u2019s honor Dinah, the silent twelfth child of Jacob, by changing the world we live in so that it is no longer one in which this The words 'son', 'daughter' and 'father' recur 31 times in the 31 verses of chapter 34. Apparently, the awful events of the chapter revolve around parents and children, and especially, what can happen when parents are run by their children, by providing too much autonomy, or too much support. <\/span><\/p>\r\nJacob and Hamor, the two fathers who cast themselves into supporting roles in the story, personify each extreme. On the one hand, parents can grant too much autonomy to their children, letting them be the masters of their own fate, make their own decisions and their own mistakes, and thereby let their children's decisions, informed by passion, unfettered by the careful measuring of consequences, determine events. This is Jacob, who allows Dinah to wander unaccompanied in an unknown city (contrast this with the precautions taken by Abraham and Isaac in Egypt and Gerar), and who does not utter a single word until the very end of the chapter, leaving it entirely up to his sons to determine the reaction to Dinah's rape. <\/span><\/p>\r\nOn the other hand are parents who can't relinquish their ownership over their children's wellbeing, but who provide for them based on the children's own sense of their needs. This is Hamor, the dedicated father who has named the city after his son, who will allow his entire town to undergo \"minor surgery\" in order to satisfy his son's infatuation. Rather than help his son, the text emphasizes that Hamor thus infantilizes him.<\/span><\/p>\r\nSimeon and Levi commit the massacre in Shechem, and ultimately they will be cursed for it, but it is two well-intentioned fathers who create the circumstances which enable it. The evidence did not prove beyond a reasonable doubt that the Appellants lacked legal \u201cjustification\u201d for their actions. Their sister had been raped and was being held prisoner by Shechem, Hamor, and their cohorts. The Appellants conspired to weaken those who held Dinah, but their objective was to free her. Although the Appellants\u2019 brothers took booty from the city and from the victims, the Appellants did not. Hence their conduct was committed in the \u201cheat of passion\u201d and was, at most, voluntary manslaughter.<\/span><\/p>\r\nII.<\/b><\/p>\r\n
DEADLY FORCE WAS NECESSARY TO SECURE<\/b><\/p>\r\n
THE RELEASE OF APPELLANTS\u2019 KIDNAPPED AND RAPED SISTER<\/b><\/p>\r\n
AND TO PROTECT THE APPELLANTS\u2019 FATHER<\/b><\/p>\r\n
Evidence established that the followers of Shechem came to their ruler\u2019s defense with force (<\/span>Or HaChaim<\/span><\/em>), and that they intended to kill the Appellants\u2019 father Jacob and seize his assets (<\/span>Malbim<\/span><\/em>). Hence the Appellants could not secure Dinah\u2019s release or their father\u2019s safety without battling and killing all the males of the city, including Shechem and Hamor. The Appellants were engaged in self-defense, as well as in a legitimate effort to secure the release of a captive.<\/span><\/p>\r\nIII.<\/b><\/p>\r\n
SHECHEM AND HIS FOLLOWERS WERE TOTALLY<\/b><\/p>\r\n
LAWLESS AND WERE LEGALLY \u201cPIRATES\u201d SUBJECT TO DEATH<\/b><\/p>\r\n
Shechem was the ruler of a totally lawless society that failed to punish wrongdoers, including his son Hamor (<\/span>Rambam<\/span><\/em>).<\/span> Hence he and his followers were enemies of mankind, as the US Supreme Court characterized pirates in an 1844 decision (<\/span>Harmony v. United States<\/span><\/em>, 43 U.S. 210, 232): \u201c[A] pirate is <\/span>hostis humani generis<\/em> <\/span>because he commits hostilities upon the subjects and property of any or all nations, without any regard to right or duty, or any pretense of public authority.\u201d The killing of pirates while they are engaged in piracy is not punishable homicide.<\/span><\/p>\r\nCONCLUSION<\/b><\/p>\r\n

Where was God at the time when her brothers plotted their revenge? Where was God at the time when they had committed their scheme? Where was God after their act of revenge was done?<\/span><\/p>\r\n Was God there at the moment of circumcision or the time when Hamor and the innocent people of his city were commanded \u201c<\/span>every male among you is circumcised<\/b>\u201d (Genesis 34:15), before they became easy prey in the hands of Jacob's sons? This was the same act of circumcision Abraham was commanded by God to perform with exactly the same words - \u201c<\/span>every male among you shall be circumcised<\/b>\u201d (Genesis 17:10), as a sign of the covenant between them. This is the covenant in which God promised Abraham progeny and a land, separateness and election. This is the same act of circumcision that Tzipora performed on her son in order to protect Moses from God who was plotting to kill him (Exodus 4:25).<\/span><\/p>\r\nApparently, circumcision managed to protect us from strangers and even from God, but it did not manage to protect us from But, the text also makes it clear that however it began, he quickly fell for her. (Whether she ever reciprocated - or whether it was an actual rape in the first place and not just described as such to negate Dinah\u2019s possible role in the matter, and to justify the honor killings perpetrated later, are all fertile fodder for the midrashic imagination). <\/span><\/p>\r\nThe text says not only that he loved her, but even <\/span>vatidbak nafsho<\/span><\/em>, <\/span><\/i>that \u201chis soul clung to her.\u201d This is the same word used in Genesis 2:24 to describe the ideal relationship between a man and his spouse: \u201cHence a man leaves his father and mother <\/span>vedavak beishto<\/span><\/em>, <\/span><\/i>and clings to his wife, so that they become one flesh.\u201d <\/span><\/p>\r\nThe word includes both an emotional component and a physical one, for it is also the same word that is used to describe how Ruth behaved towards Naomi: \u201c<\/span>ve-rut davka bah<\/span><\/em>, and Ruth clung to her\u201d (Ruth 1:14). As for Shechem, nothing could sound more pure and sincere.<\/span><\/p>\r\nIn the same way that people can cling to each other, a person can cleave to God: \u201cYou must revere the LORD your God: only Him shall you worship, <\/span>ubo tidbak<\/span><\/em>,<\/span><\/i> to Him shall you hold fast, and by His name shall you swear\u2026\u201d (Deut 10:20; see also Deut 13:5). And also in a verse known from the liturgy: <\/span>\u201c<\/span><\/i>Ve'atem hadveikim badonai<\/span><\/em>,<\/span><\/i> while you, who held fast to the LORD your God, are all alive today\u201d (Deut 4:4).<\/span><\/p>\r\nThe idea of a very physical clinging to God in Kabbalah and Hassidism became an entire theology known as <\/span>dveikut<\/span><\/em>, striving for a transcendent spiritual closeness with God, even a sort of <\/span>unio mystica<\/em> <\/span>with the divine. Another kabbaslitic use of this word, though in a different vein entirely, is when an evil spirit clings to a person, a sort of demonic possession, known as a <\/span>dybbuk<\/span><\/em>, made popular in the play by S. Ans-ky of that name.<\/span><\/p>\r\nAnother fraught, negative use in a very different context is the well-known Psalm 137 (you know, the one by Bob Marley): \u201cBy the rivers of Babylon, there we sat, sat and wept, as we thought of Zion\u2026If I forget you, O Jerusalem, let my right hand wither; <\/span>tidbak leshoni<\/em> <\/span>let my tongue stick to my palate if I cease to think of you\u201d (vv.1,5-6). That meaning is much closer to paralysis than transcendence. <\/span><\/p>\r\nIn Modern Hebrew, as with many spiritually rich traditional terms, the root has been secularized into everyday use. <\/span>
